Took me a while to be able to stomach coming back to this site, as I knew some would have gotten their visa already, but all I can say about our interview is that it was the single most horrific moment throughout this entire process. As a disclaimer, our case is definitely far more complicated than most here, as she lived in the United States already, so we had to add more time for waiting and processing of our case, so this isn't trying to scare anyone, but I don't want anyone to be as blind-sided as we were.
We showed up, third in line, for our 8:30am appointment. We were called up to the window around 8:20, which was definitely nice, but then we waited to be called until just about 10:40am. When we were finally called in to get "interviewed", the lady was incredibly rude and basically said my wife was ineligible from the very beginning based on accruing 180 plus days of unlawful presence in the United States. We had an I-212 waiver already approved and with us, as well as notes from our lawyer and information about the appeals that were ALL filed in a timely manner while she and her family lived in the States. The woman told us she didn't need to see anything from the I-212, and then shoved the rest of the paperwork we tried to give her back under the window. She said some incredibly horrible and degrading things to my wife while we were there, and in the end she gave us our denial letter and sent us on our way.
We now have our lawyer, as well as my state senator, filing paperwork to clear this up, as we have been told she was 100% in the wrong. I only post this to warn others to not take the interview lightly at all, and don't allow yourself to get too cheerful before it's actually over. We had an entire folder full of documents supporting our marriage and courtship, but she never asked to see any of it, and when we tried to bring them out, she promptly told us to return them. Many of you have met online and have had easier times, but I just wanted to give fair warning. I dated my wife for an entire year before she left the States, seeing her every day, and then for the past 2 1/2 years, I've gone over the bridge to see her in Canada EVERY weekend as well as some days during the week when work allows. We had an insane amount of evidence, but due to her having a bad day or waking up on the wrong side of the bed, we were sent away with nothing.
We're very confident we'll have this cleared up within the next few months, but fair warning to you all. I wish you all good luck and I hope no one ever has to go through this again. We plan on bringing up complaint charges against her once this is all has been panned out, and are going to try to get actions taken so that everyone is treated the way the rules and regulations of the Consulate say they should be. I am so sorry to hear this, bowflex. I'm sure a number of us have come across our share of rude and/or ignorant officers in some form or another. This person's behaviour is inexcusable, and I am sorry for the pain and heartache that you and your wife must be going through. Keep looking up.

I thank you for that. My wife and I had to suffer another 5 hours of being in Montreal after this, then our plane got delayed that was just taking us back to Toronto by another hour and a half Lol. We then had to drive from Toronto to Windsor in a snow storm, trust me it was the single hardest moment that I can remember in my entire life. While I'm really devastated right now, we're trying our best to just get back into the mindset and file everything to get it moving. I wish everyone good luck!

I cant imagine what more we can offer than the people you have already secured.You have all the support in the world here to rant, gripe, cuss ( even if its edited we'll read therough it). We're in your corner!!!!

I am sorry that you were mistreated. It is not justice. Sounds like you got a Biatch from hell to hear you case.
I dont know if it is you or somone else, they also had a problem with a CO from MTL. I think they describe her as a overweight blond lady. Is this the same person you had for your interview. Others said she is rude, stuck up and just not a nice person.
Maybe she is small in height and she has nepolian syndrom... Small person wants to act big.

Actually the woman we dealt with was an African American lady. I've heard quite a few horror stories on this site on different boards about people at the Montreal Consulate, but I guess I was just hoping it wouldn't happen to us, since we had absolutely everything we needed and more to get the case accepted. This is truly a rough day today, as I figured it would be today that we'd have the visa in hand, and I was going to pick her up right after work. Good luck everyone.

What a horror story!! It makes me so mad!!!! ... These people that are dealing with peoples whole lives should really get some person to person training ... our governments spend enough money .. you'ld think that they could invest some in training people properly .... a little hard on the issue and gentle on the person kinda training... my heart really goes out to you and your wife ...

Wow, sorry to hear this, Claudeth and I hope you are able to clean it up quickly. As for the lady, I hope she is put in a position to be able to look for a different vocation and get out of something she obviously isn't qualified to do. Good luck

I dont know what to say except that Im so sorry that you and your wife had to go through this! People like that should not be working with the public!
I hope you got her name, maybe theres some way to file a complaint against her, once you have this all cleared up..

Nothing to say for it except that I'm terribly sorry this was pushed upon you guys now. It should be over - you did everything right. As you said, you are trying to gather yourselves together to do what needs to be done now and that is where your energies should be. I'm sure we're all sending you positive energy as well.
As far as the horrible woman in Montreal. Know that at the end of this, even if you decide not to pursue action against her, I'm sure karma will have a hand to play. What comes around goes around. But who knows? Your simple grievence letter may be the one HR needs to take action against her.
I won't wish you good luck, because you don't need it .. but I will wish you "God speed".

We both really thank you for all your kind words. We've decided that we're not going to allow this to drop, even *if* we get our visa. Of course I say if now because I'm not going to get stuck in that over-optimistic frame of mind again, that's all

We're going to make sure no one else ever gets disrespected like this again for sure. Thanks again!

Kipster & I just wanted to add our support to this post. We were talking about this last night and we both see so much injustice in this.
Obviously they had their minds made up before you walked in the door (or at least this lady did), so why did they make you incurr the costs to go to Montreal? If there were questions on your case, sure by all means allow you to go to the Consulate and plead your case.. but obviously they were not interested in what your wife had to say. What a rediculous system that would allow you to go all the way with some sort of hope, only upon arrival deny you! IF they were that sure of the outcome they should never have scheduled the interview, and allowed you to go through the appeals another more dignified way.
We are angered and frustrated along with all the other posters. We're so glad you have a lawyer involved and hope and pray for a very speedy and vindicating approval down the road.

Thank you very much for that! I was venting about that on 2 of the 4 hours we had on the drive back from Toronto to Montreal. We booked 2 round trip tickets from Toronto to Montreal, got a hotel for one night there, I took 3 days off of work, and then paid the insane Canadian gas prices to get an SUV to go from Windsor to Montreal, all to be denied right on the spot after they finally called us in after a few hours of waiting.
The worst part about this process now is that she should've been home yesterday or today for sure, and now we're looking at a minimum of 30 days for the Consulate to review our grievance. I really hope this goes by smoothly, as I'm not sure how much longer I'll have a full head of hair if this continues Ha.

we had what appears to be the same interviewer, named Maya. older members can attest to my shock at dealing with her as well. In our case she misapplied some clearances and it took 7 months to clear up. Im sorry to see she is still causing issues, although I may have misunderstood what the problem is.
- asylee case never approved subsequently left on own free will, just not when they wanted her to? is 180 days accurate?

she even stated on the denial letter that i was denied september 19, 2004 and left couple weeks later. i don't understand. but then she said denied. for what reason? she had those dated right in front of her. we gathered our entire life in a couple of weeks and left the first week in october. since they didn't receive anything from the border i assume (that we left. we weren't trying to hide anything, we even had our denial with us to show we left within a couple weeks)...they sent a mandate to leave NOVEMBER. when we told her that (although she could've seen if she actually read our files) she simply said "mandate? what's a mandate? i don't know what a mandate is." seriously wtf. so in our letters to her to re-review we gave her a little refresher course in the laws and regulations and vocabulary.
the senator's office immigration helper went over our case and saw absolutely nothing wrong and no unlawful presence. but she just won't even look at it now.
edit: sent in november that we had 180 days AFTER november to leave.
