Hi there, I'm such a newbie I haven't started the process yet lol. I'm a little bit nervous here as my situation isn't "normal." My fiance and I met online in Dec 06 in a chatroom. We started off as friends. I am a self proclamed Bollywood addict who wanted to learn Hindi and he was willing to be my teacher lol. I was married at the time but we decided to call it quits around Christmas time. We are handling this very amicably, no hard feelings. We just are not compatible. We will be filling our "Dissoultion of Marriage" in Ohio within the next week or so. Should be less painful than going through a traditonal divorce.
I got to go visit my beau in India in March (we got engaged then). Will the consulate look down about that considering my past relationship official end date isn't finalized yet? I mean, the only pictures I have of us together are from that time frame. I have one hand written letter and millions of emails. =)
Originally I was going to get a K-3 visa and get married there but work won't allow me time off so we are going to try for a K-1 visa and keep our fingers crossed. Wish us luck!

As for some of your questions, your divorce needs to be final before you file the petition, because you both need to be legally able to marry and as part of the petition you need to submit copy of the divorce decree.
If your case is pretty much straight forward, you can do this (file the petition) by yourself without a lawyer or a visa service. There is a lot of information on this site and the guides and members are very helpful. I did everything by myself with the help of VJ and we got approved without any problems.
