here iam again ,last night me and my wife was fighting because i have friends,i cant have friends,i cant be on the computer i cant watch what i want,i cant do anything,life for me is a HELL now iam thinking of hiring a lawyer as you said guys but i am afraid i will lose and be denied because i have life here now,work,friends....everything.
i have these evidences.

joint bank account

joint tax return

pictures

western union statments that she sent me money before

emails

one letter from a friend in my name and hers

joint car insurance

net and cable bill in my name

electric bill in her name

lease agreement in our names

are these enough evidences???? iam really need your help guys and i love ya all i feel so happy and comfortable when i post my situation,thanks a lot.

Hiring a lawyer might be the only thing you *can* do at this point. Sounds like you have quite a bit of evidence that your marriage was in good faith at the beginning. One thing I do know...keeping a positive attitude will carry you much further. If you hire a lawyer, I would think he or she would want you to be positive as well. Good luck Jasper...really. rose.gif

i am a little confused by your statement. the title of your note mentioned "divorce" but in the body of your note, you just talked about "fighting". fighting is NOT divorce, rsrs, i know for passionate brasilian, you can think otherwise. if this is just fighting as i think you guys are now patch things up and in deep love again. i think the evidence you have so far are all good but please also review the I-751 filing instruction on this site.

the story is very different if you guys already filed for divorce and the court already sanctioned this divorce. if you already got the divorce judgement from the court, then no matter what amount of evidence you have, the chance of you getting your AOS to permenent is "near impossible".

The above info is incorrect...... if you get divorced you can file to remove conditions and as long as you have evidence to show you entered into the marriage in good faith then you stand a good chance of removing the conditions on your own..... there are 1000's of people who do just that every year.... have a chat with an immigration lawyer as well as a family lawyer....

I had a question on this. At this point, what is the legal liability of his wife under I-864 Affidavit of Support?

Divorce does nothing to end it. (40 quarters of work, citizenship, death are the only ways out). It starts from the day the AOS was approved.

yes. the informaton is incorrect if you review VisaJourney, i just did a search on the site, i found a rare 1-2 stories about "rejected' or "failure" concerning filing I751 case alone when the alien spouse filed for I-751 based on "abuse" or "good faith marriage". i think i saw ONE today by Shona. so, can i discern that CIS pretty much approve all these cases when the alien spouse show up alone making whatever claims s/he is making? if you believe that, then the information i provided earlier is not just incorrect, it is blatantly WRONG. LOL

Shona wasn't removing conditions, she was filing I-360 under WAVA. And her case hasn't been denied yet.

Lots of people remove conditions without a USC spouse's cooperation. Please, don't mislead people by saying it's "near impossible".

This is an interesting case, but it's obvious immigration fraud. I would be very surprized if a case like that was approved wacko.gif There was no bona fide marriage there whatsoever. I'm not a lawyer, but it's my opinion.

Jasper's marriage was bona fide, so he should be fine.
