there are ways to obtain a divorce if you don't know where your wife is or she will not sign the papers.

while she will not be able to stay here legally by marriage to you, she might try to find other ways to legally stay here.
you mention the friend she is staying with has made allegations about you. you need to contact an attorney and do everything you can to protect yourself.
i know this is a difficult time, but you'll get tru it...

Starting Line


(K1 Introduction) - If you are just starting your K1 visa journey, please check out this information provided by the Department of State (DOS) on the K1 visa experience [CLICK HERE]. I found this information very insightful when I first started. Please note that the "How to Apply for a Social Security Number Card" section is INCORRECT because K1 visa beneficiaries may ONLY apply for a SSN card upon arriving into the United States. (K1 Visa Immigration Stages) - A simplified and theoretical overview of the five (5) stages involved in the K1 Visa process, according to Sheriff Uling [CLICK HERE].

Post NOA1 (Receipt Notice) Information


(Case Status) - Once you have filed your case and received your case number, please register on the U.S. Citizenship and Immigration Services (USCIS) website using the Case Status Online Tool to receive emailed updates concerning your case [CLICK HERE]. NOTE: If you want emailed updates to multiple addresses then you must create multiple customer portfolio accounts. When your petition is approval (NOA2), this tool is of no further use to you until after the beneficiary arrives in the states, get's married, applies for the Adjustment of Status (AOS), Employment Authorization Document, (EAD), and/or Advance Parole (AP) because this tool does not track the activity being performed at the National Visa Center (NVC) or the Manila Embassy.

Post NOA2 (Approval Notice) Information

(1). The National Visa Center (NVC) number is within my signature. NVC assigns your case number once your case is approved (NOA2). They also may perform a preliminary background check, from what I've read, then forwards your package (electronically and via snail mail) to the Manila Embassy. This process normally takes approximately 14 – 30 days.

(2). The Manila Embassy (USE) number is within my signature. Please review this instructional visa interview information [CLICK HERE] (Thx Sillygirl). The average visa interview appointment/medical exam are scheduled by the USE approximately 90 – 120 days after the receipt of your package sent by the NVC. Even though the USE has received you package electronically, the process will not begin until the paper copy is received via snail mail.

The beneficiary may or may not received a Letter of Receipt [SAMPLE HERE] (Thx PW and GaryC) accompanied by a Document Preparation Letter [SAMPLE HERE] (Thx PW and GaryC) from the USE once their physical files are delivered to the USE from the NVC. Don't be mistakened, this is NOT Packet 3 because the USE ONLY issues Packet 4. At times, the USE fails to send the beneficiary the Letter of Receipt and Document Preparation Letter, which is of no real consequence and may arrive in approximately 30 - 60 days.

However, the beneficiary SHOULD and NEEDS to receive an Appointment Letter [SAMPLE HERE] accompanied by the infamous Packet 4 [MODIFIED SAMPLE HERE], which should arrive approximately 60 - 90 days after the receipt of the hard-copy case file sent by the NVC to the USE. The Packet 4 currently sent from the USE to the beneficiaries INCORRECTLY states that the DS-156 (Nonimmigrant Visa Application) is validated by the banks upon paying the visa application fee. The pdf file for the Packet 4 link (above) is modified to CORRECTLY read that the DS-157 Supplemental Nonimmigrant Application is the form validated by the bank upon paying the visa application fee.

As of 01 November 2006, ALL nonimmigrant visa applicants MUST use the online Electronic Visa Application Form (EVAF) to complete the DS-156 (Nonimmigrant Visa Application) at http://evisaforms.state.gov. You may complete the DS-156K (Nonimmigrant Fiancé(e) Visa Application), and the DS-157 (Supplemental Nonimmigrant Visa Application) and the I-134 (Affidavit of Support) via computer (recommended), type-writer (just as good), or handwritten (last resort). To review the K1 Visa Forms (DS-156, DS-156K, DS-157, & I-134) most Frequently Asked Questions [CLICK HERE]. To review the Manila Embassy Thread's recommendations on what to bring (which directly corresponds to the document preparation letter and Packet 4 sent by the USE) and sample questions asked by the Consular Officer during the visa interview [CLICK HERE]. If you need to call the USE, dial 0 for the operator, and ask for the Immigrant Visa Unit (even though the K1 Visa is a nonimmigrant visa, they are handled like immigrant visa because of the intent to migrate to the United States). Effective 01 March 2007, cellphones and other electronic devices will NOT be permitted into the US Embassy and applicants who bring such devices will be DENIED entry.

Be advised once the beneficiary reaches the pre-screeners, the majority of them are very direct, rude, and mean, so don't be alarmed or discouraged by them.


(3).The Department of State (DOS) number is within my signature. After your case is approved (NOA2) and reaches the Manila Embassy, you may call DOS instead on the Manila Embassy to obtain status of your case and make inquiries concerning your interview date. NOTE: DOS has no direct participation in the K1 process.

(4). The Visa Interview Appointments website is within my signature (the beneficiary's interview appointment and medical exam will be scheduled by the USE). NOTE: Please do NOT press enter after the case number is entered because that will not yield a result. Please click on the "Check Appointment" tab. If the appointments have been scheduled, the following will be available: Case Number, Visa Classification, St. Luke's appointment Date, and Embassy Appointment Date, but if the appointments are NOT scheduled yet, the result will be "Case Number Not Found on Appointment List."

(5). St. Luke's Extension Clinic (SLEC) information is within my signature. SLEC is where the beneficiary goes to take the medical exam and vaccination. The process takes two days: Day 1 is the medical exam (the beneficiary's passport will be taken and sent to the USE along with the medical exam results) and; Day 2 is the vaccination (the beneficiary will be given the x-ray film and the vaccination worksheet/record). NOTE: If the Manila Embassy does not mail the beneficiary the K1 Visa Packet 4 and the Appointment Letter, then call SLEC in order to pick them up at SLEC and take a copy of the NOA2, a copy of the NVC letter (a.k.a. Bureau of Consular Affairs (BCA) letter) (which should have the beneficiary's Manila case number on it), and a print-out of the scheduled appointment dates from the Visa Interview Appointments website. Be advised, the beneficiary's medical exam will be scheduled one week before the visa interview by the USE. Per the Manila Embassy Thread, we recommend that the beneficiary takes the medical exam anywhere from 2 weeks to a month before the interview to ensure the results are available for the Consular Officer and to prepare in the unfortunate event of unfavorable medical results. If the medical exam is taken anytime over a month before the visa interview, there is a risk that the results could be invalid, which means the beneficiary will have to take another medical exam before the visa can be approved. The beneficiary may reschedule the medical exam appointment with SLEC after the medical exam and visa interview dates are assigned by calling SLEC. Please don't forget to bring your passport, appointment letter (if received), passport photos (the size of the photos should be 2 inches by 2 inches [see Packet 4, page 8]), and the medical exam fee to your appointment. The beneficiary also needs to have the sponsors contact information (address, phone number, and ssn #) for the SLEC forms. (6). The DELBROS website is within my signature. DELBROS is the company responsible for delivering the beneficiary's Visa and POE information. The DELBROS delivery fee is paid subsequent to the beneficiary's visa interview at the Manila Embassy. The only way to correspond with Delbros is via text, which can be extremely frustrating if you visa delivery is delayed. Per the Manila Embassy website, the current delivery fee/time is as follows:

* Metro Manila Areas, 135 Philippine Pesos, Delivered one (1) to three (3) business days after release of visaed passport to the courier
* Provincial Key Cities (ex. Cebu City, Davao City, etc.) 165 Philippine Pesos; Delivered three (3) to five (5) business days after release of visaed passport to the courier
* Outside Provincial Key Cities, (ex. Capiz, Leyte, Bukidnon, etc.), Cost depends on area/location, Delivered five (5) to seven (7) business days after release of visaed passport to the courier

NOTE: Per the DELBROS staff, the Manila Embassy can take as much as three (3) business days to release the visa and POE package, which is NOT included in the deliver times above. You may also call the Manila Embassy, dial 0 for the operator, and ask for Delbros, after the visa is approve, to acquire about the status of your visa delivery.

(7). Beneficiaries are required to attend a CFO Guidance and Counseling Seminar that are held in Manila and Cebu, whichever is more convenient, before traveling abroad (the corresponding links within my signature). Attending the CFO Guidance and Counseling Seminar is a Philippine government requirement which states, "Per Republic Act 8239 and Department of Foreign Affairs (DFA) Order 28-94, Filipinos proceeding abroad as fiancé(e)s and spouses of foreign nationals are required to attend the CFO's guidance and counseling programs... " For more info [CLICK HERE]. NOTE: The CFO Guidance and Counseling Seminar is not stated as a requirement within the Packet 4 instructions. However, after the visa is approved, instructions on attending the CFO Guidance and Counseling seminar are included in the visa and Port of Entry (POE) package received by the beneficiary. If the beneficiary takes the seminar before receiving the visa, then the beneficiary will have to return to the CFO in order to receive the CFO sticker anytime after the visa is received. Travel abroad is prohibited without the CFO sticker within the beneficiary's passport (the visa is within the passport). (8). The I-94 Arrival / Departure Record form is within my signature. Foreigners (beneficiaries) complete the I-94 and the Customs and Border Protection (CBP) officer stamps the applicant's visa and the arrival and departure portions of the I-94 at the Port of Entry (POE) when entering the States. The CBP Officer will keep the arrival portion and staple the departure portion of the I-94 to your visa where they stamped the beneficiaries arrival date. You will need this for the Adjustment of Status process. NOTE: Even though it's simple, I have supplied this so you will know what it looks like and what is required to be filled out. Have a great flight!

Has anybody tracked packages from NVC lately? I tried to track using Correspondence as reference but it doesn't seem to work, the website says:

This reference was found on a large number of shipments. Unable to track using this search criteria.

Any suggestions on how I can look up mailings from NVC to MNL embassy? Thanks!

I somewhat apoligize that I post this here. But, I have been a memeber here a long time and respect the opinions and feedback that I receive here very much. I appreciate the concern and caring of all of you that have replied to me here. I hope and pray that you have happiness and a blessed life together.

Glenn, I have been following your story and was thinking about your case and how you are doing now, glad you're back. Roy gave you a good advice, seek help from an Attorney for a dvivorce. Even if you don't know her exact address, since she's living in your area, I think you can file divorce and publish in a local newspaper for 3 days or weeks (?), not sure, but you have to do it through your Attorney, they will know better on how this process works. You also need to follow up your complaint with the authorities about the missing person report you filed for your wife (ex-wife to be), since she showed up with the police. There are legal and illegal ways she can do to stay in the US. But if your petition has been withdrawn, she should get deported. But, if she files for "abuse/maltreatment" (rape as you mentioned), she can use this as a reason so she can file for a stay and maybe even file for AOS by herself without your help? Please seek a good Attorney, so you won't loose "some" of your assets and most importantly, your reputation.

Question on POE. So far, only medical forms and CFO asked what port my fiancee will arrive in US. Once we recieve our visa and go make ticket arrangements, does it or will it matter if the we enter into another port.
Example:
We put honolulu on form but may use Continental to Honolulu. The problem is it goes through Guam which is US territory and requires all to do immigration there.

Does anyone see an issue with this? I do believe the visa is generic to any port and not one port specific.

My fiancee will ask the immigration officer this Thursday once interview is over.

Hi DJ. It doesn't matter if your actual point of entry is different from the POE you guys wrote down in the forms. I had to ask this, myself, as I did not know which point of entry I would be using at the moment. smile.gif

That is what I thought considering most can't make travel arrangements until the dreaded Delbros delivers. We are trying direct on PI airlines but way too expensive and full. China Air or Continental airlines are relative cheap.

Of course going through Guam immigration is alright because so small and all filipinos.

Yes, I am going to pursue the divorce by publication method. I am at pure disbelief that she would dare make any allegations against me. Rape? I was married to her and there was never any pressure even by me. She was willing always. My petition is withdrawn and I filed a case with ICE about 2 weeks ago. She should be deported. I know I was used by her, but I don't intend to pay out money to her or suffer from her wrong doings anymore. I will fight her in court if I have to. I do not want to see her be successful from her plan. I have evidence of her lesbian desires, such as her laptop sites visited, copy of her ad looking for women, photos she downloaded of naked women and her friends statement that she is a lesbian, as well as her so called cousin is not her cousin, but her lover.

Glenn, I have been following your story and was thinking about your case and how you are doing now, glad you're back. Roy gave you a good advice, seek help from an Attorney for a dvivorce. Even if you don't know her exact address, since she's living in your area, I think you can file divorce and publish in a local newspaper for 3 days or weeks (?), not sure, but you have to do it through your Attorney, they will know better on how this process works. You also need to follow up your complaint with the authorities about the missing person report you filed for your wife (ex-wife to be), since she showed up with the police. There are legal and illegal ways she can do to stay in the US. But if your petition has been withdrawn, she should get deported. But, if she files for "abuse/maltreatment" (rape as you mentioned), she can use this as a reason so she can file for a stay and maybe even file for AOS by herself without your help? Please seek a good Attorney, so you won't loose "some" of your assets and most importantly, your reputation.

Yes, I read these pages and I think it is clear that she can stay here if she continues with her lies. It looks to me that there is nothing that I can do about it at all. Glenn, it is a good thing you filed the ICE complaint prior to her allegations. I spoke with out Immigrations/Customs liasion in our office and she stated the folks over at the ICE fully expect false charges and allegations from illegal aliens in attempts to remain in country. Keep all the documentation you have and if you have not done so, change your number so the out-laws have no way of contacting you. Good luck, Ken

I was faced with this same dilema. My Fiance wanted me to come for her interview and also to excort her back. Trouble was that I did not have enough time on the books at work to stay more than 10 days. (8 days after travel time) I did not think it was a good idea to guess when her visa would be issued and get a ticket for the end of that time frame. Secondly, I did not have enough money with plane tickets to Manila costing about $1000 each to make two trips in hopefully less than a month. Consequently, I told me sweetheart it was one or the other. I would come for the interview and she would fly here alone or I would skip the interview and come to get her. She, bless her heart, told me she understood and without a complaint out of her lips said she wanted me there for her interview most of all. So that's what I am doing.

And good news is.....I hop on the plane tomorrow night for Manila!!! WOOOHOO!!!! kicking.gif kicking.gif kicking.gif Can't wait to see my baby again!!!! Hope I remember everything! I gotta work tomight too and I haven't even started to pack! ohmy.gif I am soooo bad! tongue.gif

The Embassy will send the visa applicant a Fiance Visa Appointment Packet. there is no per se packet 3 in Manila. Some receive a letter from the Embassy when the petition is received by the Embassy. My wife did't receive the letter, so don't worry if you don't get one.

Glenn, everything is in your hands, the odds are against her. She cannot stay. If she self-petitions as an abused spouse, she needs to provide overwhelming evidence to prove abuse to meet eligibility requirements. By golly, to prove that you did everything for her, you can tell the court to read your posts in VJ. Your posts are a timeline and testament of your love, loyalty and faithfulness to her. She, on the other hand, was looking for lesbian lovers on the internet. I'm sure her self-petition (if she dares) will be denied outright as her case is a no-brainer.

The reason her relatives and friends were sending you text messages/emails of abuse and "rape" is so they can fabricate lies and provoke you into saying something that they could use against you later on. Stay cool and calm in all these and avoid contact so you avoid being provoked.

I am also sure that when she emailed you to say that she will come back, she realized then that it would be very difficult for her to adjust status and that she would be needing your help in order for her to do that. I know it's hard to say no to someone you love but you have to "read" her motivations for wanting to stay together with you. Fraud and love do not mix together.

Two weeks after NOA2, your petitioner in the US will receive a letter from the Bureau of Consular Affairs (BCA) advising him that his petition is being transferred to Manila. 4-6 weeks after the BCA letter, you (the beneficiary) will receive a pre-appointment letter from the US Embassy. Then 8 weeks later, you will receive Packet 4.

I'm kind of worried that it's taking kind of long for me as I've heard of one who has an interview date of June 5 (orion44) and got the packet 4 last week. Should I call St. Lukes to have it picked up there or is it too early for me to get worried? I just wanted to make sure that everything is set for my judgment day. Any helpful tips would be high appreciated. Thanks guys!

I would just call St. Lukes and make arrangements to pick it up there (if it's no inconvenience to you).

The USE usually sends out the Appointment Letter and Packet 4 once your appointments (medical exam and visa interview) are scheduled. Hopefully you have acquired most or all of the required documents because it's a pain in the rear. If not, [CLICK HERE] to review our modified version (our version is modified to correctly site the DS-157 Supplemental Nonimmigrant Application as the form that is validated by the bank upon paying the visa application fee).

It would be wise to have it all available but i don't think the CO will question much of your 8th year relationship yes.gif It is a sure approval for me good.gif As long as all important documents are complete especially DS forms, BC, NBI, Police Cert, Ceno if applicable, I134, and other important dox in your case.

We are in our 4th year and we did prep all and we mean ALL (snail mails, emails, phone logs, etc for each year) and they only asked for 3 snail mails (original) and that's it. But as a good advise have everything available at least to cover 2-3 correspondence for each year and the most important is within the 2 year period when you applied for this petition and also include the current ones. Just be prepared with all the possible documents to support your relationship. You wouldn't know what they are going to ask until you get there. I know the whole process is stressful but you'll do great good.gif

Hi all! Got back here in the US @ 1am of the 29th. It was an extra long trip (45hours total, door to door) this time with a lot of long layovers since we had to re-schedule our flight and was on a waiting list.

Our POE was LAX this time and I had no trouble whatsoever going through immigration using my greencard that's in my married name and my passport that's in my maiden name. They didn't even ask for a copy of the marriage certificate. They just input your passport number in their system and I guess it verifies you. But i would still suggest bringing a copy of the marriage certificate, just to be sure.

We had 4 hrs of layover in hongkong, then another 4hrs in LA but we as we boarded the plane for our connecting flight, we were grounded for an hour because there was a dust/sand storm in Phoenix. So, when we finally got to Phoenix, the last boarding call for our connecting flight to Kansas was being announced. We had to run all the way from one concourse to another. Boy, what an experience.

Congratulations to everyone who got their interview dates, their visa approved and got married! Had a lot of catching up to do here.

You can try to call SLEC for the packet pick-up, but you need to be patient as their phone lines are always busy. Phone numbers: 521-0020 and 521-8647. Or you can go there directly and ask for a packet pick-up, which is located at their ground floor, The last window on the right (I think it is window F). But if you already have the schedule, print that out (USEM website: http://203.177.135.10/ivappointment/login.asp ) and you can use that as your appointment letter to get an early medical, or you can also use your copy of the NOA-2 if you want an early medical while you're already at SLEC (just a suggestion, so you won't be wasting time).

Now that was are married, now we need to get her SSN? Do we need to wait till we have our marriage certificate?

After she gets her SSN, i will add her to my Medical insurance also.

The long wait is finally over! Shiela picked up her visa from the Delbros office in Dumaguete today! kicking.gif kicking.gif

The Delbros website has had the visa "Shipment Out for Delivery" since 04/25, and we had not received any texts or phone calls. So, yesterday morning I called the Delbros main office line. They told me the visa was in Dumaguete, and then gave me the office number there. When I called the office, I had to listen to them complain about how difficult it was to deliver it to Shiela's home in Bayawan City, even though that's what we paid them for. mad.gif So I told them to hold it there, and Shiela went to pick it up from the Delbros office in Dumaguete... HALLELUJAH!!!

Such a long journey! I was beginning to think the embassy would never release the visa. I called the day before it was released, and all they would say is their standard AR story line "undergoing routine checks. Call back in 4 to 6 weeks". But they released it the next day.

Anyway, thanks to you all for your prayers and support. You can finally update my timeline, PW. Picked up from Delbros in Dumaguete on 05/01, only whistling.gif 35 days after we turned in all the required documents.

Good to hear that you and El have the best of times now,congratz on your wedding!
You need to have your certified true copy of your Marriage upon filing for her SSN..That is what they ask when I filed mine..I have my SSN card today after 1 week. kicking.gif
