Thank you Mae and Gracy for the replies. I really appreciate it and thank you really.
Good Luck to all of us in this journey.
God bless.

*i have another question... do we need to go to Malacanang Palace after we get the CENOMAR for seal or something. I hear from someone telling me that, and she said too it will take about one month to get the CENOMAR after i make a request for it. Anyways i'm going to the NSO tomorrow to get my BC and CENOMAR. Thank you very much again.
Lina
No need to go to Malacanang if you apply in US.
If you get CENOMAR took 10 working days, mand the BC is 3 days .
Good luck to you

Hello....

Mirasol seems to think that the Baptismal Certificate is a required document, but I dont see it listed in any of the paperwork. Can anyone confirm or deny if a Baptismal Certificate is required in the Manila Embassy for a K1 applicant?

Thanks.

Scott (and Mirasol)

The baptismal certificate can be used as evidence of birth when the birth certificate is unavailable. However, the NSO in the Philippines must have proof of birth before entering a "late registration" into the National Statistics database and issuing an 'official' birth certificate. Official NSO documents are required by the Manila U.S. Embassy.

Hi again everyone blush.gif
how many weeks or days can a CENOMAR be released if i get one. I heard it is one month from the date you requested. thanks. i hope someone will answer me. thank you again.

CENOMAR; if you apply online on e-census it takes not longer than 6 days, much faster. But if you apply in the NSO office it takes 2 full weeks, mine takes 3 weeks because of the holy week.

Just correction on my first post..
CENOMAR; if you apply online on e-census it takes not longer than 6 days costs P400, much faster. But if you apply in the NSO office it takes 2 full weeks it costs P180, mine takes 3 weeks because of the holy week. I had to get both because the one from e-census has the wrong birthplace and i couldn't have it corrected, thus wasting P400, it was confusing when you fill out online where to put birthplace, so to make sure i went to the NSO office and secure another copy.

I guess depends on the NSO branch. I never knew i could get it the same day if that's possible here in Manila then how come i didnt know it i even talked to the officer to release it faster than 3 weeks but they wont but i didn't offer any red tape i don't have to i believe since i still have enough time. CENOMAR no need to have authenticated at the Malacaņang as far as I know

What should I do? It has been over 48 hours now since I have heard anything related to her.I have no choice but to feel that I have been used. We were married in the Philippines on December 29, 2005. Do I file for divorce here in USA? I have emailed my attorney, but no response. I think he is only good at cashing checks. He was a major waste of $3000 for sure. Did she do this just to get here in the USA? If so, how can she stay? We had not applied for AOS. I don't like being used and want to know where she is.

Have you cancelled her cell phone account yet? You should. You can probably expect that the bill will be extremely large by now. There is nothing for you or an immigration attorney to do regarding her status--that's on her and there is nothing you can change.

Yes you can file for divorce in the US.

If you have any other joint accounts, close them. You need to protect yourself from further abuse.

I haven't filed a missing persons report as of yet. She contacted her cousin in the Philippines and told her to contact me. I have to assume that she is okay and is not interested in any contact with me.

Glenn, this is just so sad. I know that this is a difficult time for you and I hope and pray that you find the strength and courage to face whatever it is that lies ahead. I hope that you will continue to let us know here how you are doing. Has your lawyer made any contact with you yet?

Hang in there! We're just a computer away if you need someone to talk to.

Glenn,

I would start with a missing person report with your local police. They will not tell you where she is if she is located because she is an adult, but they can tell you that she was located and she just chooses not to have contact with you. I know it will hurt, but at least then you will know for sure what is the status of your relationship. Not knowing now where she is or her mental state makes you wonder if she really wants out, or just wants space and is going about it the wrong way. Just my opinion, but talking about divoricing a woman you love so dearly when you haven't explored all options to find her and get her back seems premature, but maybe I dont have all the facts. You need to know what her intentions are for sure and that is one way to know....assuming the cops can find her through her cousin. I get the feeling her family knows where she is, but just isn't telling....but maybe would let a police officer talk to her just to know she is okay. Also, if she does try to leave the country to go home, she will be flagged at any airport trying to leave the country. So again....you may not know where she is, but at least you will know she is okay and is just choosing for whatever reason to end the relationship in a very wrong way....given the facts we know.

Sorry to hear of this and I pray all will be well, one way or another.

1) Most ITRs are filed on-line nowadays and do not require signatures (someone correct me if I'm wrong). Therefore, my take on this is that if fax copy is acceptable to the embassy as written in the packet and their website, then (I hope I am assuming correctly that) an ITR filed on-line and therefore downloaded from an IRS website is more reliable. I am putting this to the test during my interview on Friday. I will be using a downloaded 1040 and PDF copy of W2. The worst that can happen to me is to be put in AR but I have waited so long that waiting another month is not a big deal to me anymore <sour-graping> hehe

2) A bank statement needs to be signed by a bank officer. He can request the bank for certification by phone-call, e-mail or snail mail. He will probably be charged $30!!!! so the bank will need his authorization for this. He should not forget to tell the bank where to mail the certification as it might be mailed to his last known address listed with the bank.

Thank you sooo much for your reply Patiently Waiting.. Please kindly let me know if they'll accept the downloaded forms.. And God bless on your interview on friday.

I applied for CENOMAR thru internet since I didn't have time to travel and get caught up on long queuing. It cost me Php300 per copy and it was delivered one week after I paid for it at the bank. But as Gracy have said it, it usually takes one day to get a copy at NSO.

Mae

How many copy of CENOMAR and BC did you request?

I don't know what happened here? I am in shock and a little intoxicated. My wife went for a bike ride this morning at 9:30am and never came back. All she took was her money, jewels and passport. I received an email from her cousin in the Philippines 8 hours later that said my wife is safe and for me to move on with my life. I am in shock. I married her in the Phils 18 months ago, she was here 1 day short of two months and she is gone. Day after day she said she was depressed and homesick. The only disagreement we had was yesterday. It was about her $1028.00 cell phone bill where she had been calling the Philippines at $3.00 a minute instead of using our landline international service.

I don't know if I have been used or what. I am just in shock and have nobody to talk with.

Glenn

So sorry to hear this Glenn, I know this must be a tremendous shock. I don't know what I would do if I were in your shoes at the moment other than try and locate her and let her know you love her and want what is best for her. Maybe for now you can try and chat with her family back home and let them all know how you feel and that you are worried about Rosemaria's safety. Soon she will have to come back and talk about this with you, because you are both married, for Christ's sakes!!!! I know you have done all you can do for now, we will be praying with you for her return. You will come out of this a stronger man I really believe.

At this time sure you dont know the whole story, but i agree with others that you need to protect your self.

I think if she will contact you, maybe she will tell you her story.

But at this point it we dont want to make up stories of what we THINK she is doing!

Hello to all, i know this question is already asked but i just can't find the right thread and am a lil lazy looking for it blush.gif ... anyway, my question is: Is it ok if I only have a computer printed copy of my husband's Form 1040(ITR)? Actually it is his copy of his ITR when he filed the tax online. Just want to make sure i have the right documents. Hoping for your response... Thanks a lot!

For my interview on Friday, I will be using a computer print-out (TurboTax) of my fiance's Form 1040 and a PDF copy of his W2. His 1040 has a Declaration Control Number and date of acceptance by TurboTax. I will let you know if embassy will accept that.

Is it ok to submit photocopies of my fiancee's ITRs? He doesn't have the transcripts... and he's not comfortable in sending the original ITR forms he filed for the last 3 years...

Mae

What I'm thinking it doesn't matter what is the form of ( photocopy, transcript...) your ITR. what the CO is concerned with is your income level. They may already have our income levels from the government databases. I submited copies of my W-2's, pay check stubs, letter from employer and IRS Tax Transcripts. those who are self employed or using assets should have documentation to back up their income.

Thank you for the replies!!! It makes me feel better that what i have is ok based on what you pals said here.

I dont know the whole story but based on what your posts you did what you can to help her. I really hope that she will look back to the times that you two are so much in love with each other, the hardships you had when u were still miles apart and worked on things just to be together and i hope this will help her make up her mind to see you and patch things up for the good of your marriage. Will they really look at the 1040 or will they focus on I-134? I'm having a hard time explaining to my fiancee about tax transcripts. He said he hasn't heard anything about it but he got the 1040 but as much as possible he wouldn't want to risk sending the originals thru any mail services.

Embassy accepts faxed copy of 1040 and W2 so have your fiance fax those to you. It's easy for embassy to check the data with IRS so I think it's not really a big deal with them if you submit copies.

The 3-year ITR and/or tax transcript are no longer required by the embassy. Latest 1040 and W2 are what they look for now. However, if you want all your bases covered, your fiance can request for tax transcript from the IRS. Click here for more details http://www.irs.gov/individuals/article/0,,id=110571,00.html

Rosemarie will not be able to adjust status without you and remember, you are the only way she can legally adjust. However, since you are married to her already, she can legally stay in the US for two years before she will need your help in removing conditions. As suggested earlier by another poster and since you don't know what she is thinking right now, protect your finances in the meantime. She may have broken your heart but don't let this situation break you financially too.

Even if you were married in the Philippines, you may file for divorce in the USA. A US divorce between an American citizen and a Filipino citizen is recognized here.

Luvbugs, I will update the list tomorrow night. I'm sleepy. Good night everyone!

Thank you all for your sympathies and condolences.

Finally got done with the travel arrangements and we're getting on a plane this afternoon... not looking forward to this homecoming.

Glenn, I said it before, you need to report her to the authorities as a missing person. that is the first step. Then go to ICE to report the fraud if that is what you truely feel. I personally think her relatives in the PI were only hearing her side of her story and gave her some bad advice. You need to protect yourself form reposnosibilities as her sponsor at this point. You can always cancel the "missing persons" filing and the Fraud charges, but you need to cover your collective arse at this point. Hopefully she will do the honorable thing and at least contact you and give you a reason so this can all end well and not with two people full of anger towards each other. Ken & Maria

If your fiance is in the military as you indicated earlier, he will not need a co-sponsor and is only required to meet 100% of the prverty requirement, not the 125% liek everyone else. Most all military members are above the poverty line because of their benefits like base housing, COLA, BAH and BAS...etc. Ken

The Embassy is only looking for the last years ITR to confirm your AIG is more than the poverty line requirement. If it is, the other ITRs are not needed. I had 3 years worth, all scanned copies printed on my personal computer and they only wanted the latest ITR and W2. If you meet the poveryt line requirements, they will likely do the same thing they did to us at the interview... they handed back the letters of employment, bank statement, pay stubs..ect. But it is a good idea to have them with you. Good Luck, Ken

Hi Patiently Waiting....

I'm really excited I finally found a co-sposor for my wife Lorna.....

You posted something recently for Glenn about if Lorna was to leave me before her lifting of conditions (CR-1) then she would need me to do the lifting of conditions process? I mean...I'm trying to cover all bases for my co-sponsor.

If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated?

Which would relieve the co-sponsor of olbligation?

Believe me I have no reason to beieve she will leave me. This is a "what if" scenario that must be looked at.... just like what happens if I die before she becomes a citizen.

Anyway, any help on this would be appreciated.
God bless, Mike

What should I do? It has been over 48 hours now since I have heard anything related to her.I have no choice but to feel that I have been used. We were married in the Philippines on December 29, 2005. Do I file for divorce here in USA? I have emailed my attorney, but no response. I think he is only good at cashing checks. He was a major waste of $3000 for sure. Did she do this just to get here in the USA? If so, how can she stay? We had not applied for AOS. I don't like being used and want to know where she is.

Technically, I think the answer to that question is NO. Plenty of illegals have obtained govt. benefits. Practically, if she's no longer in your life, I would suspect she'd probably be out of the country, thus relieving you and co-sponsor.

Hoy dims, where in Oregon you are from. I noticed it in your profile that it said cave junction OR. I am a beaver alum and Lived in Corvallis and Monmouth when I went to OSU. I also worked for a year in Dallas too. I am back home in Hawaii now. I miss OR sometimes, esp in the summer, hehe. Also good luck in bringing your wife here. I hope it works out for you.

My fiance printed out his 2004-2006 ITRs already. And we are planning to have it notarized (though I know it's not really needed) along with I-134.

You said on your reply to other poster that majority of military members are above the poverty line because of their benefits, my fiance in in military, so is that mean that we will be fine?

Thanks for the reply by the way.

K1 Immigrations Stages (Simplified and Theoretical)

Based upon my research, there are five stages in the K1 immigration process:

1. Petition Stage (required)
- US Citizen (USC) petitions to bring the alien fiance(e) to the United States. Petition is approved.

2. K1 Visa Stage (required)
- Alien fiance(e) submits visa applications, supporting documentation, takes a medical exam, and attends a visa interview. K1 Visa is approved and issued to the alien fiance(e) or "Nonimmigrant" permitting travel to the United States.

3. Adjustment of Status (AOS) Stage (required)
- Alien fiance(e) or "Nonimmigrant" arrives in the US, marries petitioner (USC) and files for AOS within 90 days. Some applicants may be scheduled for an AOS interview. AOS is approved. Green Card [conditional one-time two year expiration if married for less than two years] is received and status adjusts from "Nonimmigrant" to "Permanent Resident."

4. Lifting the Conditions of Residence Stage (required)
- "Permanent Resident" and USC file jointly to remove the conditions of residence. Condition of residence is removed. "Permanent Resident" receives Green Card [renewable ten year expiration]. Status remains "Permanent Resident."

5. Naturalization Stage (optional)
- "Permanent Resident" has the option of applying for US Citizenship [naturalization] after three years of being married to a US Citizen (one year after lifting the conditions of residence). Applicant attends a naturalization interview. Naturalization is approved and the issuance of the Certificate of Naturalization officially adjusts the status from "Permanent Resident" to "US Citizen."

Hope this helps...

NOTE: Please provide feedback (editorials and criticism), but also remember that the blurb underneath the stages is simplified and theoretical.

Cheers!!!

That's how I understand it. the obligation would end when she left the country. on the brighter side and you have a happy life together , the obligation for you co-sponsor would end if she becomes a US Citizen. that could be in as little as 3 years.
hope we'll soon receive good news from DocMay and george&jenny on the results of their interview.
best of luck to gelramos & daveandfleur on their interviews tomorrow.

Can we attend both the CR1 and K3 interviews? If so what might the outcome be? Our K3 is May 16 and our CR1 is May 30. We want the CR1, but were told we could go to the K3 and request the CR1. With a CR1 interview pending is that wise of us to do still? Or just wait? We'd certainly LOVE to get back to the US sooner and if we can secure the CR1 on the 16th would be great.

Also, if they issues a K3 on the 16th and not CR1, can we still go on the 30th and get the CR1???

I feel so behind the curve, not even sending my packett to USCIS yet.

Ayayay! What are you waiting for? Send it out before the two years since you last saw her is up. You don't need to show income upfront when filing the I-129F. Income will be required 6-8 months from now during the interview. By that time, you're well above the poverty level.

If it's been two years and a day since you were in the Philippines, you will need to come back here to satisfy the requirement of having met within the last two years. I'm not even sure how USCIS will count the days when you last saw her ~ date of receipt at USCIS? or date of adjudication? For example, if you saw her last on May 15, 2005 and then you send in the I-129F on April 15, 2007 which is still within two years, but at the time USCIS adjudicates the case on July 15 (assuming you are processing through California or Texas), then it would have been 2 months after the 2-year requirement. Then, the adjudicator may have a reason to deny your petition. When was the last time you saw her by the way (month and year).

Hi PW and Sheriff! I haven't seen my fiancee since November 2004 but we got approved already by the USCIS and on our way for the interview on 04/25 at USE Manila. Will this affect the approval of her visa? I am not going to the Philippines until next month...I'm worried unsure.gif Please assure me it's going to be okay.

Kimtung also had their K-3 and CR-1 only a few days apart. they attended the K-3 and were advised by the CO to pursue the CR-1, which I beleive they did. I don't think you'll be interviewed for CR-1 on the 16th. you'll have to go back on the 30th for that interview.

don't worry, you'll be fine. the requirement for having met in the previous two years is for the submission of the
129F petition. best of luck with your upcoming interview. good.gif

Oh bother! Fely's having trouble getting documents again. She went to her local town to get her police certificate so that she can send all her papers to me and I can send them on to the NVC. After 2 hours waiting she was told the police chief had an emergency and couldn't sign her certificate right away. She's off to Manila tomorrow, so I told her to just forget the police certificate and send me what she's got. She'll send them once she's in Manila, and she plans to take her CFO seminar later this week. I hope that goes better for her than other things lately. Meanwhile I still haven't received the letter from the NVC telling me what documents I forgot to send with the I864 package.

Jackie, I responded to your PM but I'll say it again here. The travel agent lied or just does not know better. You CAN use a one way ticket. A good friend of mine came on a one way ticket in March. (she was K-1)

This one really alarmed me: http://www.visajourney.com/forums/index.php?showtopic=63240 as David and I have huge age difference (he's 62 and I'm 28). I will be his 4th wife. He's twice divorced - 1st and 3rd marriage and the 2nd wife died of a certain illness, but it is the first time that he filed for a K1. I've been worrying about our age difference because other says it's a red flag and I will be scrutinized during the interview, while some says it won't affect the approval of the visa as long as my petitioner can meet 125% poverty guidelines and we have all the necessary documents to prove that our relationship is bonafide. I've never been married, no kids, never traveled abroad so there's no way that I'll have a problem on my part... The age gap thing is what concerns me more (just now after reading Doc's post) because of cases being put on AR / denied.

Guys, please enlighten me... Should I really be concerned and worried? And one more thing, is it very likely that a CO can deny a visa just because he's not feeling well and having a bad day??? See, I'm getting paranoid. blink.gif

Anyone here who made it through despite the huge age gap? I really need some inspiration...

Mae

I wouldnt put so much power on the cogress womans shoulders there my friend.
They have no power over the visa process other than making enquierys about the status of your case.
Its more likely that the administrative process was complete and they just finally processed the visa for you.
I am glad to see you finally get your visa,we got the same delbros info today as you did and we been on AR since 2/27 and i didnt contact any congress or any outside help other than calling on occasion and checking the status myself.
Sometimes the AR is for simple name checks and NSO documents being verified.
Good luck with the rest of your journey,i am now making flight arrangments so i can go get my babes first week of May smile.gif

The travel agent is applying Philippine Law to another country. Unless you are an LPR or balikbayan or Philippine citizen you must have a round-trip or onward ticket to enter the Philippines.
I know, I know, some are going to say they know someone who didn't have another ticket out of the P.I., but that is the law and they can refuse entry if they want to. It has happened.
