First, I would like to say hello to everyone here and let you guys know that this site is great for getting alot of information. I have read many forms here, and feel little bit better now after reading everyone's questions and answer. I was first gonna get a lawyer to do my case, since i was so worried that it might take a long time for all this process to be complete and for my wife to come over to US.

I also apologize if this is the wrong place to post this kinda of topic. I just got married on March 6, 2007, in India, and just got back to the states recently. I was not able to put my wife's file in India since i heard that the offices were not accepting any more files, not sure how true that is thou. So basically i have to do everything from here. I understand what needs to be done on my behalf, but am a bit worried on my wife's behalf.

First of all, I know i have to file I-130 then i have a option to file for k-3 for my spouse. My question is, what is the process for k-3 on my spouse's behalf?

What forms does she need to complete or what she needs to do?

I read on the forums somewhere, that my spouse needs to have medical records completed. Should i tell my spouse to get that done now so she doesnt have to do that later, or wait for the NOA?

Should i go with k-3, or just wait for the I-130 to be completed?

If i decided to go with k-3 and then my I-130 gets completed before k-3, what happens next? Can i opt out for k-3 or i have to go through the whole process?

Also for the I-130 forms, I have my spouse passport style photos, but are not 2X2. Do they have to be 2X2? They are more like 1.5X1.5, i had not realize that the size was smaller in India until i came here to take my passport photos.

I dont know if anyone knows an answer to this but, on my citizenship paper, my birthday is incorrect. On my liencse and passport the birthday is correct. Will this affect the process for my spouse? Is there anyway i can change my birthday on my citizenship paper?

She will need to undergo medical exam, but it is usually done after your case is forwarded to your designated consulate. She can start gathering her vaccination record while waiting for NOA2. These are the vaccines she needs.

If you want her to come the soonest, K-3 is the best. However, the difference of timeline of K-3 and CR-1 are not that big. K-3 petition is a good back-up though if your I-130 approval seems longer.

You can only get 1 type of visa. Usually, CR-1 prevails over K-3. With CR-1, your wife will enter US as an immigrant thus greencard will be issued not later than a month (meaning she can work, apply for driver's license, get insurance and so on).

Don't take the risk. Submit 2x2 ID. She can email you the digital copy of the photo, then you have can it printed at 2x2.

You can also check the timelines of people from your embassy who have filed for either a K-3 or CR-1 visas. That should give you an idea of how long each might take to get processed.
