My Aunt, from the Philippines, was married to an American citizen for a couple years and had just completed the Green Card paperwork/process last Fall. He unfortunately died two months ago and she is being told that she cannot receive his survivor benefits until she receives the Green Card. Is that correct? Has anyone else been through this?
For Clarification they were and she still is living in the States.

What type of survivor benefits are you referring to? If she's been in the States for a couple of years, is she now receiving her conditional or permanent residency status (green card)? Was she named as beneficiary before the death of the spouse in order for her to be eligible for these 'survivor' benefits? I'm sorry but I think you need to provide more detail before anyone here can assist you.
