chabo,

You will need an I-130 for your stepson eventually, but you do not need it at the same time that you submit an I-130 for your wife.

I suggest you read the I-130 instructions again with regard to filing an I-130 for a stepchild.

Is it ok to wait until after the K-3 and K-4 visas are approved to file for the I130 for a step child?

Leney,

Yes, it's OK. That's what I did, although I would not do it that way if I were petitioning today.

There is a potential problem with that, which is that it's possible although not probable that your wife could wind up getting an immigrant visa, leaving your stepson without a K4. But you can control that possibility and guarantee that it won't happen, so yes you can put off the I-130 for your stepson if you want to.

You will have to file the I-130 for the boy prior to or concurrent with his application to adjust status.
