when our lawyer sent the K1 petition to USCIS last Oct. 2006, she included the affidavit of support and had my fiance's mom as our co-sponsor because my fiance didn't file for his 2005 ITR and couldn't prove his income.(self-employed). My interview is on May 2007 and my fiance filed for the 2006 tax and his income is more than enough. Will I bring a copy of Affidavit of Support she made or just bring the 2006 ITR that my fiance filed and don't need a co-sponsor? I believe the US embassy has the copy of the approved petition, u think I will be fine if they saw the affidavit of support that we sent to USCIS or they just want the 2006 ITR?

The affidavit of support is not needed until the visa interview (in the benficiaries' country). Why your lawyer included it in the petition packet, I'll never know. (Though a lawyer not knowing something about this process - not the first time that's happened laughing.gif

Anyway, what is an ITR? Are you saying your fiance (who I assume is the USC?) did not file his tax return in 2005? If so, he should file it asap. As the embassy will have seen the affidavit at the time of the interview, they may already know that he didn't file taxes in 2005. At any rate, they will also be expecting a new, more updated version, so I don't see how the 'old' version would hurt you - just as long as you make sure that your fiance has sorted out his taxes in the meantime.

Yes, I think that's right. ITR is income tax return, I'm assuming.

I also meant to say, I dunno why a self employed person couldn't 'prove' their income. Unless he kept no records of any kind (sort of dangerous, I'd think!).

just have the MOST RECENT INCOME TAX RETURN (2006) and you will be fine. Good Luck!
