Hi All!

There's a question on the DS-230 Part II, "Have you ever been refused admission to the United States port-of-entry?". If your answer is YES, would that affect the approval of the visa? What are the chances that a visa could be denied because of this? Just curious. Thanks

Depends on why you were denied entry.

No, it will not affect the approval of your visa. They will probably ask you about it and you can tell them why you were denied. In most cases, it's just because you didn't have enough ties with Canada, etc etc. As long as you tell the truth, that's fine. I was refused at the border too and I documented that in my DS-230. I'm sure they'll ask me about it and I will definitely tell them about it when I go for my interview.

Not enough evidence to prove I have ties in Canada. Not working at that time, not renting (living w/ parents), no return ticket.

I had the exact same thing happen to me. I answered 'Yes' for the question, and they didn't even bring it up at the interview!

Does anyone know if they can deny the activation of my K1 because of being denied at POE before? I am worried, I am activating it on Saturday!

the likelihood that they'd not activate your visa is slim to none. Theonly reason I can think of that a K1 would not be activated after its been granted by the consulate would be if you committ some crime as a last hurrah before you leave and theres a warrant for your arrest. Or if you say at the POE you're only getting married to the Yank so you can get the green card and leave them for some sea lion at Sea World in San D.

To the OP. If you were denied entry for any reason, DO put it on the DS forms! They'll know about it already at the consulate, if you answer NO, your visa will likely be denied or tied up in administrative review. If you answer truthfully, it should not negatively affect you at all. Dozens of us Canucks answered Yes to that question. Its about half and half whether or not it gets brought up at the interview.

In 1988/1989, I was denied entry twice (through Canada PFI's), and delayed (read, "denied for particular flight, was able to come in one day later on different flight) entry due to improper TN-1 offer-letter format.

Basically, include a separate sheet detailing the reason for refusal.

(note: there are some cases where the reason will bin the app: membership in terrorist or totalitarian org such as Nazi, Communist, al-Qaeda/affil; multiple felonies)

FYI, the question is also asked on N-400 forms (I was naturalised in April 2005, which is known to many of the other VJ Canucks).

This has happened to others as well, as long as you were honest, all should be ok!!

Definately be honest as often - they already know the answer anyway. They guy who interviewed me said it was common to hear of people being denied or at least pulled into secondary at least once throughout this process. Don't worry about it at all.

Darcy was denied at the border before. We checked 'yes' on the form. It was never an issue.

I have been denied twice. I was honest at the border and I will be honest at the Interview. I'm not too worried it.

The first time I didn't have a return ticket and the second time I brought all I could, but they still felt I didn't have enough ties to Canada.

It says on the sheet that the Border guy gave me that I will not be allowed into the US unless I have my Visa.

My husband was not only denied entry to US for not enough ties, but was held in customs for 5 hours, sent back, and then put on the "watch list". Although he wasn't given an actual ban, he couldn't get over the line even to just go to a border town. He was granted his visa and the Consular only said casually, "Ah, stopped from coming over I see? Yeah, that happens a lot"

Not that it's a thrill to be on the "watch list" Married_my_love, but I do feel better knowing that I am not the only one. *And*, that being on the "watch list" will not prevent the K-1 from being issued. I have been kinda worried about that (in a "back-burner" kind of sense in my mind) all along. I answered Yes on the DS-230 about it (advice from another VJer).

I was only yelled and screamed at for 2 hours, not 5. Wow. That must've been horrific. My next 2 visits after that ordeal that I made before the K-1 process began I was required to bring in a small binder of evidence of ties and they issued me an I-94 and put a B-2 stamp in my passport for each crossing. Since K-1, though, no crossing at all. I'd probably be considered a HUGE major risk now. smile.gif

this topic is very helpful to me...i will have my interview on the 10th of april...i was denied entry last february 2004...the immigration officer there think that i had worked there everytime i visited for the last 3 years.had my visa 2001.multiple visa for 10 years...i never overstayed each visit i had...then the last time was feb of 2004..i was refuse entry..now im married with usc last year and i will have my interview next month..will that refuse entry will affect anything on my interview?all i know is that the immigration officer told me that i can apply for tourist visa again after 5 years..so whats the meaning of that?im i ban for 5 years and will that affect anything to my interview as a spouse of usc??please help me....does anyone had problems like this?or even requested for a waiver??good luck to all!!!!godbless..
