hey everyone. we had our aos interview but are waiting for the fbi clearance. they removed the i-94 from his passport. can he still travel with ap even though that is not in his passport?

I'm pretty sure you have to have Advanced Parole to travel under these circumstances because technically he does not have a green card yet. 'Passing' the interview is not the same thing as being granted permanent status.

Yes, as long as you have AP document in hand, they wont jump on you for the I-94 when leaving the country. When returning to the country you will probably get a new I-94 card in your passport due to still being a non-immigrant until having the green-card.

When you do get the green-card, you can discard the second I-94 due to status changing from Non-immigrant to Lawful Permanent Resident.

I have a friend in this community whose husband is stuck in namecheck and his I94 was removed at the AOS interview.

They left the country last week to attend his father's wedding. None of us know yet exactly what happened, but we know they were delayed exiting the country, and she phoned a mutual friend and left the cryptic message 'I hate immigration' on the machine.

We are waiting for her return, and once I know the story, I will relay it. I'm anxious to learn if he was given trouble leaving because of the lack of the I94. It could be something completely different, but we shall see.
