Full Version: Will the I 824 affect the K3 process?

We filed for the K3 Visa after we had sent the I 824 to have the 1 130 sent to the NVC. There has been no touch on the I 824 since November.

Will the K3 still go through? I have heard that the processing center will hold on to I 130 petitions if you file a K3.

Now that we have a K3 filed, I would prefer to take that route. I don't know if the I 824 will mess that up at all.

Any ideas?

Breathe Stacey. You requested the I-130 to be transferred. The I-824 has nothing to do with the I-129F.

If you had not submitted an I-129f petition prior to the approval of the I-130, why did you submit an I-824? Absent an I-129f the I-130 will be sent to the NVC as a matter of course.

It's difficult to tell by Stacey's post but there are reasons that I recall from early posts of hers. The I-130 had originally been filed when she was in the US. They had been going to adjust status. Instead she was denied entry back into the US after a visit back home. Pretty sure I have got that right. So they were told to file the I-824 to have it transferred to NVC so a visa can now be applied for.

Yes. Aussiewench is right. I was in the US when we first filed. I came home to have a visit and was denied re-entry.

Back then we didn't know much at all about this whole process. We did have a few people say to file a K3 and others who said not to because the I 130 will be faster. ??? We were getting conflicting advice from everyone- which made it even harder.

It wasn't until I found VJ that I was finally getting all the info and advice we really needed.

Finding out the I 824 can take about 6 months to process is what made us file for K3. Plus with a K3- I am assuming I will go out of Vancouver for that, which is faster that Montreal.
