Full Version: Should my cousin submit an I-129F too?

Hi guys,


This is for my cousin. She's about to get married to her boyfriend of 3 years this weekend here in California and the husband (who's the USC) wants to file an I-130 for her. Now my question is, I was looking at the forums and some of you guys filed an I-129F too (which is a petition for a fiancee or something). Now I'm confused because why will you file an I-129F if you guys are already married.

I'm trying to help my cousin and I'm confused. Can someone here please enlightened me? Thank you!

The I-129F is also used for a spouse (see instructions for how to complete for a spouse). The I-129F is filed along with a copy of the NOA receipt notice from the I-130. Once approved and forwarded to the consulate/embassy, this will enable the spouse to apply for a K-3 visa.

your cousin's spouse would FIRST send the I130 petition and when NOA is received by the USC then the I129F petition will be sent off.
