So, after the I-130 was approved, we received a packet with all the necessary forms to be filled out. I am confused about the I-864 affidavit of support. I have no income ( I was a student until last year and then moved to Romania and I am not working ). From my understanding, my parents would have to fill out this form. I have several questions to clear out:
- Do I still have to fill out an I-864, even though I have 0 income and I am on my parents' taxes?
- My parents fill their taxes as jointly. I am planning to use both their incomes for the I-864 (one of them makes enough to meet the poverty level, but just be on the safe side). In this case, one of them must complete I-864 and the other I-864a?
- Does my husband have to show both W-2's and the tax returns? ( is it enough to show the 1040 photocopied and w2's? I'm not really sure about the term "tax returns" biggrin.gif )

You are the primary sponsor due to the fact that you petitioned for the visa, so you still are on the hook to support the immigrant, and MUST fill out an I-864, your parent also fills out an I-864 as a joint sponsor.

I-864a is used by an other member of household to provide additional income support.

If your parents file taxes jointly only 1 I-864 is needed from them.

Only photocopies of the 1040,w2,1099 are needed.

Another option to the (1040,W2,1099) are tax transcripts, free from the IRS.
