Full Version: N400 submittal 3 months prior to GC 5 year anniversary mark?

I submitted my N400 last week and I just got my package returned to me saying that I'd filed it too early, my GC resident since date is 06/17/02 so I assumed that a 90day prior to anniversary submittal date of 03/19/07 would work. They stamped it, barcoded it, stamped the back of my check and on 03/21/07 decided the continuous residence dates didn't match up! What's the deal here Am I just a math idiot or is there a secret formula these guys use that I'm unaware of? I'm assuming the 3 months they reference is equivalent to 90 days, counting back from my 06/17/02 reseident since date that puts me at 03/19/07 by my calculation. Is this more complicated than this?

I would assume you are correct. My GC date is 6/13 and I mailed my stuff in on 3/15. USPS shows they received it the next day but I still haven't received any letter from USCIS. What service center did you mail to? (Not that it should make a difference, math is the same all over the country I would hope...)

No I don't think this is the issue the letter quite clearly states the 3 month calculation as the issue, I've done a couple of 10 day vacations back to England but nothing longer than that. I think they just have a weird way of calculating the 90 days. By my calculation it was exactly 90 days when they recieved it, I think they're just being super picky! a day here or there. I'm just going to resubmit it tomorrow after I've checked the dates with USCIS on the phone.

It went to the California Service Center in Laguna Niguel, I think the 90 day date calculation is the issue, I guess I'll just resubmit and hope it sticks second time round!

Always a good thing to wait an extra week. I did look and yes theoretically your's was 90 days prior, but the 90th day landed exactly on their 90th. They need prior or 90+ days. So if you had waited and sent it the next day, that would have been 91 days and it wouldn't have been returned. I made sure I waited a full week before submitting mine as they are very strict about this. Just resend it back now as you are within the time limits now...

I would also advise people to wait few extra days before filing and dont file exactly 90 days before. Here is a website to calculate days between the dates.

EnglishBob, there is also an issue of including end date in the calculation. If USCIS includes end date in calculation, your application was 91 days before.
