Hi again,

My fiance (who is from Turkey) overstayed his visa for 1 year 8 months when he was here in the U.S. While he was here, he also got a driver's license, and worked and paid taxes (I think he just wrote out a check for the taxes, never filed a tax return)

Do I need to file a waiver before I send in the I-129F forms?

You will be filing the waiver at the time of the visa interview.

This would be the 601 waiver which requires the letter proving extreme hardship. Make sure you attach all your documentation too.
