If my husband is traveling after he has filed his AOS, how long can he be out of the country and can he go alone?
Yodrak
ainfante,

If your husband came to the USA on an immigrant visa, as your profile indicates, why did he apply to adjust status?

If he did not come to the USA on an immigrant visa, what was his basis for entry? Did he apply for and obtain advance parole, if appropriate?

He can go alone, and how long he can be gone is up to him as long as he takes care to maintain his primary residence in the USA. (Same as after he adjusts.) And is back when he needs to be for his adjustment interview.

They came on a K3, Yodrak.

ainfante: You should correct your timeline to indicate this.
AInfante-Saraireh
Oh sorry. I thought I made it clear he was approved on the K3. I don't know if I even put any of this in my timeline for I didn't know how to work in the beginning. So he's a non immigrant/visa.
Yodrak
ainfante,

You didn't, that's why I asked the question.

You already have my answer to your question. Except that I need to add that he also has to head back to the USA before his visa expires.

Thanks Yodrak. He's only going for a month I believe to visit all his family.
Yodrak
ainfante,

Such a visit, in and of itself, should not be a cause for concern.
