So my Fiance fianlly got her SS card but it says, "Not valid for work" So I assume that she can't get a job right now. So at what point can she start working and how do we go about getting the correct papers that allow her to work? Thanks
raymaga
I am assuming you were approved for the Fiance Visa (K-1).

If that is the case, and your fiance is now in the U.S., you must marry within 90 days of her entry. After your marriage, you must file for Adjustment of Status (Form I-485). Along with the AOS documents, you can apply for Employment Authorization (Form I-765) and Advance Parole (Form I-131).

It takes approximately 3 months (give or take) to get the Employment Authorization approved.

Your wife will be able to work after either getting her EAD card or her Green Card.

You can then take her GC to the SSA office to get her a new SSN card (with the same number) without the notation about not being work authorized on it.

Good luck.

SSN is not authorization to work, USCIS is the department that authorizes work, you need either a Green-Card or EAD card to work. The notation on the card if you show the officer at SSA an EAD will be "With work authorization Only" (EAD) or no notation unrestricted (With Green-Card)

Then why does it say this:

1. Aliens Work Authorized Without Specific INS Authorization

The following lists nonimmigrants, by alien classification, who are authorized to work in the U.S. without specific authorization from INS. The alien’s I-94 will not have the INS employment authorization stamp and the alien will not have an EAD.

And below is listed K1 visa. Am I interpreting this wrong?

Try to find an employer that will hire an alien without work authorization card. SSA considers K-1 to be work authorized for the 90 day period of the I-94, after that they won't issue a number unless they have an EAD card or Green-card.

Being on a visa that is work authorized and BEING work authorized are two different things.

On the k-1 you are eligible to work, therefore being able to get the SSN, but that doesn't mean you ARE work authorized, thats what the EAD is for.

Sarah Rose Allen,

You are looking at the SSA policy for issuing a SS number and card.

If you want to see the requirements for an employer to hire an employee, look at I-9 and the USCIS manual M-279, Handbook for Employers
