Hi everybody,

No sense in beating around the bush, so I'll just go straight to the point. My spouse (USC) and I have been separated for quite sometime now give or take 2 years. But we are not legally divorced or separated. When I mean "separated", I meant she left me for a another guy (her ex) apparently according to her friends she never got over him and I don't even know her whereabouts or now to contact her...anyways, my question is, for the last 2 years 2005 & 2006, I filed my taxes as "single" instead of "married filing jointly" or married filing separately... I think at that time I did it out of spite for my wife without having to think of the consequences. Moving forward, I have just recently filed my N400 and have done my biometrics fingerprinting already. I am just waiting for my interview letter to arrive.

Will my filing as "single" for the last two years affect my chances in getting my citizenship? Will I be questioned about it? What are my options?

I think it might all depend. If you are applying for USC through marriage (3 years of PR) then that very well might be a big issue at the interview. If you are applying 5 years after PR, though originally based on marriage, it will come up but maybe not as problematic as the other.

I'm sure the taxes won't be the main focus of your interview, once they find out your situation, then they'll be really investigating and asking you all about that. The tax part is just an extra piece of evidence they can use to determine your eligibility. You'll have a lot more evidence for them though, so all your evidence will be now of interest to them to verfify without a shadow that you're marriage was originally based as 'real'...
