Full Version: Question about Temp. EADs

Hello, we will be going in to the USCIS office because it has been well over 90 days since we applied for our EAD. It says we need to bring some passport photos; does this mean they will give us a Temp EAD on the spot? Or will we need to wait for it to come in the mail. Also, can we use the Temp EAD to get a SSN from the social security office? Thanks for all of your input!!!

No, they stopped doing that I'm afraid. Going to the office will result in them calling up the NBC and asking them to hurry up, from what I've heard. You'll probably still have a few weeks to wait.

Unfortunately (and as dr_lha) mentions, the local offices no longer issue the cards. You may wish to schedule an infopass appt and also call USCIS.

I always see people write in that the local office calls NBC. This is great. In our case they refuse to help us...

Good luck and I am sure you'll get the EAD soon but start contacting ppl. Once you get the EAD, you can get the SSN

Yeah, I kind of got the impression that when they stopped issuing temp EADs the real result is that they can now ignore the 90 day promise, and you have no recourse. Sorry you're in the situation you are.

They're breaking their own f$##$# law. And I could sue them but it costs money and everything these days is a toss up!

Point of clarification: all EADs are temporary, they all expire.

Are you perhaps asking about an interim EAD? Yes, you should be able to use an interim EAD to get a SSN.

The law is that if your case is not decided upon within 90 days, you are eligible to receive an interim EAD. This is what lawyers have told me. Now, we can not hold them to this law unfortunately and if you check out the AILF site, you will see that this is a violation of the law.

The USCIS does continue to issue interim EADs. Note that the law does not dictate that the interim EADs must be issued by District and Sub offices.

I expect that the AILA is going after USCIS for being inconsistent. Inconsistency is a problem that the USCIS tends to have, especially when changing procedures. It's a big organization.

Wait..I am fully aware that district offices do not issue interim EADs. And excuse me for sounding perhaps a bit miffed but what procedure has changed that denies an applicant an interim EAD? We have been waiting for over one year for the EAD and there are a few cases such as mine. I don't think AILA has a problem with the new procedure, they have a problem when the applicants such as us are being DENIED the interim EAD and are losing income.

Btw, we applied when the district offices issued EADs and from that time we have been denied. In our case, the district office will not even check with NBC and defer back to us saying they can't help us and to handle things ourselves.

USCIS does not issue interim EAD any longer. Under law they are required to do so, but currently they are working to elimintae the need to issue these by processing EADs before the 90 days is up.

If a client goes to the DO and requests an interim EAD, the DO contacts NBC and asks them to approve the "regular" EAD. The EAD coming from NBC is a regular EAD and not an "interim" one.

This is exactly what I said in this thread earlier, but Yodrak disputed it, saying that the NBC do give out 240 day interim EADs. Anyone on here who actually got one of these interim EADs from the NBC?
