I see now (thursday night) that i did not send a certification of single status over with the interview docs. Actually, I never went to city hall to get one.

I assume that this is a deal breaker for me? headbonk.gif

The interview is Tuesday in HCMC.

Any experience, thoughts on this?

If they are anything like China, the consulate only needs that from the benificiary, not the petitioner. So your Fiancee only needs that, not the US Citizen.

Are you divorced? I wouldn't say it's a deal breaker. They don't always look at all the paper work that is presented. If they do catch this, it would only mean a delay until your fiancee can provide the document.

I'd get the doc's now and anticipate that they will catch it so you have it ready to go when they request it. If they don't catch it, all the merrier.

Edit: P.S. I didn't sent mine or my fiancee's letter of intent to marry with the I-129 petition and still got approved without an RFE. It all depends on who's handling the case...

I sent my divorce decree. it's just that single certificate.

I think you will be OK. The Divorce Decree is good proof that you are single.

I believe the single certificate is only required from your fiancee in VN. No point in looking back now, keep your fiancee's spirits up and the support coming. What ever happens, we are all here to tackle it with you.

Best wishes!!!

Anh Map,

Most important thing to remember: There is NO one single piece of paper will make or break your case, it is the totality of your evidence package that will.

HCMC will catch you missing the "unspoken" requirement document.
HCMC will ask for your Single Status Certificate.
HCMC will not interview your wife until she gets what they ask for.

Divorce Decreed does not prove you are single and available to be married. It shows that you were divorced to whomever you previously married, named listed on the Decreed. How do we know you are NOT currently married to someone else?

Single Status Certificate: both, USC and VNC must have.

s2convt: I think Anh Map is talking about the VISA approval, not just a petition approval of I-129F.

you dont need a single paper only your fiancee

The divorce degree is enough. I submitted to them only the divorce degree from David, they didn't require me more.
Be calm and sleep well, Anh Map.

Hi VJ,

To my case, we have been both single (never get married, never divorce), so i only need to submit them my single certificate status right? Tracy, my fiance is on his way to here and he does not have that paper (the lawyer did not ask us for this paper and seems the Consulate does not require it from Tracy'side either). Hope my guess is right so i would not be worried that we were lack any doc.

Thanks in advance

HCMC did ask for it in my case and others who filed 2-3 years back.
HCMC may no longer ask for one, but does not mean they won't.
If you can get one easily, get it. Or else, just wait until they delay your case and then go get one.
It's up to you really, I learned I have no control over a lot of issue in this process. It is recommended to cover all the basis and matters that are in your control. Sure, I would be doing EXTRA evidence and support documents, but what else could I do to make sure all T's are crossed and I's are dotted. The answer is: documents that were requested in the past by HCMC, may not be the case nowadays, I will have them TOO!
That's just me brother smile.gif Rather be safe than sorry, I'm sure where AnhMap questioned it, he thought about it too and couldn't sleep smile.gif So, again, if's easy to get one, get it! IMHO!

chuckandkim,

Are you Vietnamese American? I think they do not require single status certificate for the petitioner any more here in HCMC, they also do not require translated docs from Vietnamese into English either. How nice! If i do not make a mistake, i had called and asked them directly about this before i submitted packet 3. biggrin.gif No worry, anh Map. You will be fine. Make sure your fiancee well known about your ex's information...

We wish you the best luck!

If i'm single do i still need a proof of that for K-1 visa? does my fiance need one?
T&T
Huan, you do not need the single certificate (i can guarantee that 100%), your fiancee needs one (just in case) but actually they do not require it in the packet 4 listed either.

Good luck to you!

I was told as an American citizen that for me to even get my single paper that Id have to obtain it at the consulate in HCM. I think only the American needs it if he or she is marrying in another country...e.g. the reason k-1's need it to marry here.
T&T
They DO NOT need petitioner's single certificate status. I passed the interview today easily and no body asked me about it. Do not worry Anh Map. You will get PINK. Good luck to your interview tomorrow!
