Full Version: how long does fiance have to enter US on K-1 Visa

I have a couple of questions actually. my fiance just had his interview and received his K-1 visa....i know this is valid for 6 months to travel to the usa but we're not planning a wedding until late summer, and i know we have 3 months to marry once he's here, but does that give us 9 months then on his visa, because we don't want it to run out.....also at the interview, they asked his travel plan dates and he said, May(this is when we origianally planned) but some things have changed now so my other question is will this effect his visa in any way.....

Very simple:

Your fiance has six months from the date the visa was placed in the passport to leave his/her country.

Once in America, you have 90 days from the date of entry to marry.

If you want to get married in say August then you might not what him/her to come here before June or the visa will expire.

I don't think what you told them holds you to that travel time frame.

Check the expiration date on your visa to see the date by which you must use it.

You do NOT have 9 months to use the visa, you only have 6 months to use it. When you enter the country using your K1 visa, you then, from that date, have 90 days to legally marry. So it may seem like you have 9 months altogether - but not 9 months to get into the U.S. to begin with.

You seem to be confused about the function of the visa. The visa only allows you to go to a US POE and request entry. Once CBP has granted entry the visa has served its' purpose, so it's of no matter if it expires. What counts after entry is the amount of time CBP has allowed you to stay in the USA as indicated on the I-94 arrival/departure card.

As you recognize, the visa gives you 6 months to come to the USA. When you arrive the CBP will give you 90 days to stay.
