My wife and i had our interview on November 10 2006 Then we got her medical and police report done
Then we got an appointment for January 16 2007.
Since all the papers were good her medical and police report.
And i was using a wealthy co sponsor, my brother in law who has great tax returns for past 3 years.
I didnt work past 3 years.
So me and my co sponsor filed out the I-864 forms the embassy had given me and old one done in 2001
that had a space for a notary. I saw the new I-864 ones and they didnt have the notary space.
So me and co sponser filed both out. 2 sets of I-864 each just to be sure.
Well at my wifes January 16 appointment they told her one of the boxes on the I-864 that i filled out i forgot fill out the box with her birth date. They told her she couldnt just write it in . I had filed our origal I30 and done birth abroad for our son and every thing. Her birthdate was filled out on all the I-864
except one. They said if it was filled out she would have got her visa that day. They told her to have me send another I-864 and she could just bring it in next week with no appointment. And they told me to write a letter saying why i didnt file taxes the last 3 years. So i fedex it down.
She travels 5 hours to San Jose with a 10 month old again the following week on January 23 and is told about the Adam Walsh thing. I started a job in the states that would cause alot of people to lose money if i left. Plus i rented a house bought a truck etc. etc.. Plus i gave up my house i was renting in costa rica i missed my sons first birthday and first steps. I have put them up in an hotel/apartment she is stressed to the max. Over 2 months and no one can give us a possible day week or month time frame.

2 investors and 5 employees will lose their jobs and money and hurt all their families if i leave.
I spend 10$ every night talking to my wife who is all alone with a 1 year old she doesnt have much of a family. She has a good day and thinks about how good life will be when we are together but alot of bad days thinking she will be alone for months more.

Last week they tell us they dont have my I-864 forms . I had given them 2 sets. They said i didnt.
They said they need a my I-864 and a letter saying why i didnt file taxes.
They said they have my co sponsors I-864
I tell them they have 2 sets of my I-864 they tell me im wrong
I say how can you ask me foir a letter saying why i havent filed taxes if you havent seen my I-864
and how could you have my co sponsor I-864 without mine.
I email them the fedex slips showing the dates before and after the January 16 appointment on both slips written in the discription it says I-864 immigartion documents.

I email phone records of calls to them after the first appointment. they just say i never gave them any.
So i have sent more and now i just sit and everynight spend 10$ calling trying to make my wife believe it wont be much longer.

It seems that USCIS has made a mess of a lot of cases, such as yours. Unfortunately, as one poor person said loudly enough for everyone to hear at the local USCIS office here in Seattle..... "the problem is... we need them.... they don't need us"!!!!! All of us in the waiting room couldn't help but smile, knowing he was absolutely right, and also knowing there isn't a darn thing we can do about it.

Has the embassy in Costa Rica requested that you just send a new set of I-864 since it seems like they're not making any effort to find the one you fed-exed originally?

I didnt fedex the first 2 sets to them I fedex them to my my wife they were held at the fedex office and my wife picked them up.
The first set right before her January 16 appointment . the second set right after the January 16 appointment when they said one box of her birthdate wasnt filled out.
I have sent another set to them directly because it is 5 hours for my wife to travel with the baby.
I still cant get over the fact that they said. I never gave them any.
But i even showed them an email they sent to me asking me to write a letter explaining why i didnt file taxes for the last 3 years.
I said how can you ask me for a letter saying that when you say you havent seen my I-864.
I didnt try to make them upset. I just want to point out i now have spent 83$ 3 times sending the same documents.
I just read the post about someone getting some kind of responce from Nicaragua
about Hounduras starting to do something.

I wrote about the USCIS in Honduras, we share the same USCIS office, they cover Honduras, El Salvador, Nicaragua and Costa Rica. I lived in Costa Rica for 5 years and have been the Embassy there a number of time. They never really jammed me up like they have you. I just remember they were not very helpful and distant, I could never get anyone to talk to me or, answer any questions. The difference between the Embassy here in Nicaragua and Costa Rica is like night and day. The first time I called them, I spoke with a live human being, a USC who actually knew something and was able to answer my question and help me out. Not so with the Costa Rican Embassy.

I have tried to call the CIS office in Honduras and I can't get past the person who answers the phone. The last time I talked to her, she gave false information. I don't think it was intentional, she is just at the low end of the food chain, and just answers the phone, she just didn't know. I was just about ready to take a bus up there and talk to someone face to face when I got an email from the embassy here, I posted the email it under "USCIS office in Honduras received instructions to start process I-130's"

There is not much I can tell you, raymaga is right, "the problem is... we need them.... they don't need us"! It could be worse, they could say re-file everything from the States at the USCIS office that handles the part of the country you live in. But they made a mistake and they won't admit they are wrong, who knows, maybe the guy who goofed might get fired, so he is covering his butt at your expense. If you are dealing with a local and not a USC, Tico's never admit when they are wrong, saving face and all that. So getting them to admit they made a mistake is not going to happen. You might want to consider taking the paperwork there in person, get a receipt with a name on it.

What I can do is keep you posted on any news I get from my Embassy ,or, if I get anything from the CIS office in Honduras.

The other thing you might want to do is this. While I was in Costa Rica I went online and downloaded Skype on to my computer. I got tired of paying the monopolized Costa Rican phone company all that money to call the States. With Skype, I call the states and I talk all I want for 2 cents a minute. I know they have several Radios Shack's in Costa Rica, one in San Jose, Barrio Amo, by the INS building. Get a headset with a Microphone and you can make a lot of calls for $10.00

My wifes father is a Nico in fact her last name is Ortega. I wanted to like Panama because of the good roads because i was into restoring antique cars. But the temperature and no misquitos and 30 minutes to the beach just outweighed all the negitives of CR.

So, is your wife related to our President? So far so good with him as president, but my wife tells me horror stories of what life was like when he was president before. Personally, I think he's gotten a little older and has some money and is not about to make any radical changes that's going to upset the money that's being poured into this country.

Yeah, I know the area where you live, been there several times. I lived all over Costa Rica, on the beach, up in the mountains, but mainly and for the most time I live in San Jose, Barrio Amo, ground zero from all the action. I had the perfect bachelor pad, an old mansion with all the beautiful wood work from trees that are now extinct, a tropical garden with a hot tub. In a way, I miss all that. But it was too much, I got tired of being Tico 'ed all the time. If you are ever in San Jose you can see some of my art, there are several hotels that have murals and painting I did. Nicaragua is a lot better in a lot of ways, the roads are a lot better here. There are better deals if you want to buy property and build. Costa Rica is insane, the cost of living there is almost the same as the states without the benefits or protection. Nicaragua is like Costa Rica was 20 years ago. To be honest, I've had it with both places. I do think Nicaragua is a little better place to live than Costa Rica as far as the bullshit goes. One thing for sure, the Nica's and the Tica's don't like each other, I don't see much difference between them, they'd both be better off cooperating with each other instead of fighting. But there is a history that goes back to the Walker days when they were fighting a war with each other.

What I think you might want to consider, get your paperwork completed as soon as you can by doing whatever it takes to do it. The I-130's are being checked in Honduras right now. I think within a month or, a month and a half they will be done with them all. I've looked at the numbers for the amount of people that have applied for family visas in the past for all the countries the CIS office in Tegucigalpa, Honduras covers. I have a ruff idea of how many people they will be processing, from July 27 (my birthday) to January 23. I hope to God they are starting backwards, January first and working back to July. Anyway, my point is, to have everything ready so that when they sent back your information you can go for your final interview and get your visa as soon as possible.

Of course this is an educated guess, I think what they might be doing is one country at a time starting with Honduras, and it's a toss to see who's next. But I think there is a little pressure from up high to get this done ASAP. They'll have one person working full time on it. I am also assuming they have access to a computer data base and it will only take a ten minutes to do a check on someone, so factor in 6 people per hour, or maybe 40 people a day. The figure I come up with is two months, but it's a conservative estimate and I'm assuming facts I don't know, but it's my best guess.

I told you if I got any more information I'd pass it on to you. I don't know if you had a chance to read about the new news from Honduras. It seems I was wrong in my estimation about how long it's going to take to process the I-130's. As of yesterday the Embassy here in Nicaragua told me they are already 1/2 there with all the petitions they sent to Honduras, they are really moving on this. I think I'll be getting mine within a couple of weeks at the most. Most likely next week. I think what they are doing in Honduras is this; they are going down the list, starting with anyone who filed on .or, after July 27. I don't think they are doing it Embassy by Embassy like I first thought, but by what date you filed. As they go down the list and check the name's, at the end of the day, they sent the information to the corresponding Embassy. Be it Costa Rica, Honduras or Dominical. I think they are almost finished with working on October, and will move on to September soon. They only started checking 10 days ago and are already halfway done. So, I'm thinking we won't have too much longer of a wait, at least I hope so.

I want to apologize to you, I thought I was giving you solid information, but it seems like I was giving you false hope. I didn't mean to do that and I'm sorry. If you check out what I wrote in my string I found out everything in Honduras is just a random shot in getting the petitions processed.

You and I both have been in Central America long enough to know how things work and how different they work from the way things work in the States. My main problem is, I use to be an Electrical Engineer in charge of a design team for Intel and I think like an Engineer. Everything in order and logically done. As we both know, that kind of thinking runs a muck down here. You either change your way of thinking or, you're going to be pissed off most of the time. Like I said in the other response, I thought I was dealing with American logic.

However, I truly believe it's going to be sooner than later. One thing I do know, there are more people that apply for family visas in Nicaragua then there are in Costa Rica. you can check for yourself on the USCIS web site. So, whatever line you have in Costa Rica is going to be shorter than ours. but with everything being random, who knows anymore. this Adam Walsh thing jammed us both up and I know we're both going to be happy when it's over. It can't be much longer for either of us. And it's still better by far than filing from the States.
