I went to our local license bureau today to renew my learner's permit. They would not do it and insisted I have to have a greencard that is not expired. They didn't even bother to look at the letter from USCIS stating that my greencard had been extended for another year, while my 10-year greencard is processing. To think, I am already eligible to apply for citizenship this coming October and they are treating me as if I am out of status. The thing is, I will have to take the written exam again if I don't get my learner's permit renewed 6 months from November. With Nebraska taking too long, who knows when I will receive my 10-year greencard.

Anybody experienced the same thing? What should I do?

i know how you feel...but mine was with my state id before i got my greencard...i felt the same way like i was an illegal immigrant..

i would do what archie said if there is another office close by...or ring DMV to see what your state law is about extending permits...

1) Try not to take their reaction/treatment personally - I know, anytime someone says 'don't take it personally' we take it personally..but - the DMV is notorious for, shall we say, 'not caring' to put it nicely. About anyone. Could say, they are not 'easily impressed'..lol so don't worry everyone gets treated equally bad. Wouldn't surprise me if you went back - this time a different person and got through OK.

Side-Rule: avoid DMV at end of month and beginning of month.

By the way - their web site kind of sucks (no offense to anyone, but sheesh..how about a "Get A Drivers License" link? I tried to find out for you and really could only find snippets here and there.

Social Security Verification

Effective May 15, 2002, the Department of Motor Vehicles requires new and renewal driver license and State ID Card applicants to provide a valid social security number or a valid US Citizenship and Immigration Services I-94 document (in a valid foreign passport). If the applicant is unable to do so the driver license or State ID Card is denied.

How would they have known anything if they didn't look at it is beyond me. Hopefully a fellow Nebraskan can shed more light for you..

I live in Missouri. My I-751 is being processed in Nebraska. Actually they have denied me twice. I went in November and they told me they would not renew my permit because my greencard is expiring on January, 2007. So, I waited for the extension letter from USCIS, which they ignored. They were just sooooooooooo rude! Didn't even hear me out and had heads like a rock. I wasn't even done explaining and they already entertained somebody else. Another office is about 1 hour drive (one way) from where I live. I may just go and have it done there.

I am an american citizen, born in the USA, last month I renewed my drivers license. I have been a resident of florida for 30 years. The dmv has my complete driving history. After handing the woman my renewal and drivers license she asked me where I was born. I thought that to be a stupid question but then she asked if I was a citizen!!!!!!!!!!

I will be in a similar situation having to renew my DL with the extension letter from the I751 petition.
I hope I won't have a problem, but if they don't give me a license I will instantly call my state's senator.

I haven't experienced it... yet. If it happens to me, I will probably make an infopass appointment and very nicely ask for a I-551 stamp in my passport. It just might work.

St. Louis is a good 3-hour drive (one way!) just for a stamp when I have an official letter. If it's close, I'd probably do that. But why should I go through that when they're the ones that are ignorant with their own rules?

MarilynP, Thanks for the link. I got it printed out. I just learned from a friend who also lives in Missouri, she got a 6-year DL with no problems. She's also waiting for her 10-year greencard. A couple of months ago, our local office also denied somebody of a state ID, she was on a K1 with a valid I-94. They insisted she has to have a greencard. I've already e-mailed the head office in Jeff City and I plan on going back to the same office and make them familiar with their own rules.

I agree, you should not have to. It's just that arguing with DMV employees is sometimes a bit like wrestling a pig in a mud - you both get dirty, and the pig enjoys it.

Edit: true, USCIS can be even worse

My USCIS office is thirty minutes away, so I won't hesitate if I have any problems with DMV.

I applied an state id a couple of months ago and it was ok without asking me any requirements except passport, ssn and marriage certificate. on the form, i put physical address and po box, but on the city i put the po's city because thats where all our mail usually goes. (physical and po add is in different city)after a month, they sent me a letter saying falsifying application of state id or drivers license and they cancelled the id for indefinite time....i guess they didnt locate my exact address but i dont know why. thats the address we use on everything.

since we already moved and we already submitted aos, we already submit change of address (AR-11) but we didnt go to dmv yet because they said on their letter that i should bring 2 proofs of residency and 1 identification with picture. Since my name is not on the billing yet with our new address, my question is...does the dmv thing affect on my aos application when they do background check on my name? im really worried about it. can it cause denial on my part?

So its okay to go in with the I-94 in the passport to get a driver's license? (with SSN, of course) My fiance was going to just get the learners permit and then go back, but its better not to wait around and let anything get close to expiring? I have no problems going in there and harrassing every single person behind the counter to get what I want. lol

It is worthy to note that different states have different requirements.

My wife and stepdaughter had no problems getting learner's permits and eventual driver's licenses in Texas well before they were issued Green Cards. And Texas is not a state that hands these out to anyone without corresponding documentation as to legal status.

My advice is to look up the requirements for your state and have the necessary documents when applying for learner's permits or driver's licenses. It might also be advisable to print out your state's requirements from their website to show to state employees that don't know their own agency's regulations.

I am living here in San Antonio, Texas. I went to one of the local offices to take written exam for my learner's permit and the staff denied me because she said I didn't have Green Card. I didn't know why. Why others who also live here got theirs even they didn't have their GC, it was unfair to me.

I just read Marilyn's link in context and it appears that your DMV worker may be reading-comprehension challenged!


You are still an LPR, the expiration date on your card DOES NOT indicate expiration of legal permanent resident status.
Go talk nicely to a manager & try to not take no for an answer. You can also print the pages off of uscis.gov that explain conditions on your status. And make a copy of your extension NOA to put into their hands.
