Full Version: Remove Conditional Permanent Residency

Hi All,

I hope someone can answer my question here. I recently mailed in my completed I-751 form, along with a bunch of supporting documentation to lift the Conditional Permanent Residency on my Greencard status. Here is my question, I am supposed to file with in 90 days of expiration, which I have 60 days from. I was looking on the net for information about the process. This website (Click Here) talks about a lot of info, the one thing that I need clarification on is point #8, where it says.... "When the USCIS accepts your I-751 petition for permanent residence, they will send a filing receipt for an I-797C Notice of Action". Now, does this mean that USCIS sends this I-797C notifying me that they have received my application, and that its waiting for approval or do I get this one the application is approved itself. I need this form as I will be traveling very close to expiration date of my current greencard.

Please help, any info would be greatly appreciated.

not really sure your in the right forum, but usually the I797c from the I751 will include a one year extension to your card.

Hi John & Annie,

I couldn't see a forum that suited this topic better actually. This is a discussion based on adjustment of status for greencard based on a family type filing. Let me know if you think there is a better home for it though. I did know that when I get this I-797c, that my greencard is automatically extended for 1 year, I just dont know how long after the office receives the application (which according to USPS they have) it takes to get this I-797c back.

We have not done this yet, so I am only speaking about what I have read here.

But, I believe that this is part of the NOA1, so you should receive it one they accept your application.

btw, there is a removing conditions forum on this site. Perhaps EWOK will move it for you.

OK. I called the USCIS number today, and I was told that I should in fact receive the I-797c receipt no more than 15 days after they receive it. She said to call on the 16th day if you have not received it. These are 15 calendar days, not business days. Therefore, I should be getting it in a couple of weeks which will extend my current status for one year while they process the applications. Currently, the California office are processing applications from August 2006.
