We just mailed off the I-130 yesterday and Im already feeling the anxiety..LOL Trying to get ready for the next step which Im assuming is the I-129..?

Im the USC my husband the Canadian, we have been married, and living together in Canada for 5 years..

Ive noticed on some peoples K-3 timelines that some mention sending only the I-130 and some list sending both the I-130 and I-129... (do we still send the I-129 if we live together in the same country?)

I feel like my brain is starting to shut down because Ive been on this site almost non stop( only stopping for a few hours here and there to go to work..LOL) for the past few days jumping from forum to forum..LOL

again sorry for the dumb questions just want to be sure!

when I went through the Canadian Immigration process 5 years ago ALL info (police checks, medical, tax info, and all forms..etc) was collected and sent all together in 1 packet... so I think Im overwhelming myself in the having to get multiple packets ready..

It depends how urgently you guys want to move to the U.S., and I would also say where in Canada you live.

If you live I believe something like Saskatchewan or East, then he would go to Montreal for the K3 interview, and in that case, there isn't that much time difference gained by going for the K3.

If he enters on a K3 he won't be able to work for about 3 months and will have to pay to file for Adjustment of Status.

Also, if you do choose to file the I129F, then you will most likely be forced into choosing the K3 as the new USCIS streamlining policy means that both petitions usually get approved at the same time and the I130 is retained in the U.S. because they assume he will enter on the K3 and Adjust Status.
