Just sent it the AOS papework and waiting on the NOA1....
Has anyone applied and recieved the drivers license with thier k1. My husband has a jamaican lic. but we had stress from NJ patrols about that and now from my insurance company that he needs his NY lic.

You might want to check here...
NYS DMV...or take a trip to your local DMV to see what they require. In Colorado I had to produce 2 Government issued ID's..which in my case were my British Passport and my EAD card.

We would be interested in hearing about this as well.
Based on the DMV website (http://www.nydmv.state.ny.us/idlicense.htm#idpoints) it seems that a foreign passport with a K-1 visa is not enough of an ID to get a NY state driver's license or non-driver ID. So far we've just decided to wait for the EAD, but would be very interested in hearing of any successful experiences (especially in NYC) of anyone who managed to get a license before getting an EAD.

I waited until I had my EAD before applying for a driver's license. So I don't know about using the K-1 to get one. You have to have 6 points of identitfication according to their rules.

Unfortunatly NY is one of the states that will not give you a licence on your K1, you will either need your EAD or your Green Card to get a Permit. You will also have to take the written test, attend a 5 hour class room course, then take the road test before you will get a Licence.

Not true. I got it with my K-1 (passport), social security card, and marriage certificate.

You must have been very lucky and got someone who did not know what they were doing as UK passport does not count towards the six identity points required, as it is a foreign document. Unless they have changed there rules within the last year.

Canadian passport also is no help.
I had to wait to get my DL until I could prove that I had permission to be here at least a year. I used my AP after I got the 1 year stamp.

Well this is taken from their site:-
A foreign passport with your visa and form I-94. The passport must be in English or translated by an embassy. The I-94 must have been issued by the INS for a period of at least one year and must be valid for at least six more months when presented to the DMV. It also says that this equals 3 points.....so you would be half way there with a passport.

NY drivers license for a person in temporary status will have "Temp visitor, status expires ......" on it in red text. Generally the status expires at the same time as your I-94 or EAD.

My I-94 was issued for 3 months only, but their system wouldn't accept anything less than 6 months,
so they had to call their supervisor to override the settings and change it to 1 year.
A foreign passport, SSN card and marriage certificate definitely give you enough points. I also had
a UK driving licence and a couple of credit cards to show them, but the problem is not the number of
points - it's convincing them that your status doesn't really expire with the I-94.

I'm glad you got your licence but you appear to have been fortunate in getting a reasonable DMV office. I was told that a UK passport would not be acceptable form of proof as it was a foreign document and was not validated by the INS for a year. I explained as a K1 it could only be issued for 3 months, they said they knew that but did not make the rules only upheld them. My Date of Birth, which was also required, could also not be proven again because the passport is a foreign document and not acceptable. i tried a different DMV office but run up against the same outcome. I gave up at that time and waited for my green card.
By the way my Licence has temporary status in red ink expires 2011, don't know where they got that date from

Hmm, you shouldn't have temporary status if you're a permanent resident!
I exchanged my temporary status licence for a proper one the moment I got my green card.

It's worth a shot. I hear conflicting stories from K-1s. As you know, my Henry is a K-3 holder. He was turned away the first time, because "the EAD and NOA2 were from the same entity...DHS." He went back a few weeks later with his passport, EAD, SS card and one other thing (I forget what). He was told "wish I could help you. Go get a utility bill and come back." So we quickly changed the light bill into his name; waited a month...it finally arrived and his last name was horribly misspelled!! Ugh! We finally got it corrected; he went back to DMV with passport, EAD, SS#, NOA2 and utility bill and he was told he could take the test right then and he only got 1 wrong and was given a temporary learner's permit. The real permit arrived 2 weeks later. He has a road test at the end of the month to get his driver's license. It seems that you get a different answer depending on which window you go to. Good luck - I hope your hubby is successful next try. Henry tried 3X before he hit the jackpot.
Oh and that whole thing about being INS validated for a year NEVER came up. Henry lost so much sleep and no one mentioned that. So....again...just keep trying.

Hi,
My wife just went to the NY DMV yesterday and was able to get a non-driver's State ID (which has the same ID requirements as driver's license). She brought her passport with her K-1 visa page, I-94, and our marriage certificate.
I'm not sure why exaclty they gave it to her (not sure of the laws behind it). Honestly, I wasn't sure if they would. But I told her that if they didn't give it to her, that she should demand to see a supervisor. So initially, they wouldn't. A supervisor was requested, and he allowed her to get a State ID. I'm assuming that because you entered on a fiance visa and now you're married that that's proof enough that you intend and are allowed to remain the US for a long period.
In any case, they let her have it. This was at the Brooklyn DMV.
