My husband (USC) and I are waiting for our final interview. Our I-130 was approved at the US Consulate in Okinawa, Japan in December 2006, in late January 2007 it was sent to be re-approved at the USCIS in Seoul Korea(due to the new law, they just have to check my husbands name) Has anyone in the Japan/Korea area been contacted about their final interview date? I heard rumors that they only had 2 people working on the cases at the USICS in Seoul Korea sad.gif

Have you heard anymore about you case?

I had planed to travel to Japan to marry in April and file the I-130 at the Tokyo embassy but now I am unsure what to do. I have been told that I have to file in the US (Texas) but if Soul Korea can do the back ground checks why do I have to send the I-130 to the US?

This is very frustrating to a lot of people.

If you are resident in the US, you are directed to file your I-130 in the US.

The petitions that are maybe-currently in Seoul have already been filed and need to be finished before throwing any more new petitions in there. While it's good to stay hopeful, US citizens who are NOT resident abroad should not be planning on having the option of filing overseas returned to them very quickly. There are several other people in line ahead of you, and you do have a filing option currently.

I think for folks in your situation, it's more disappointing than frustrating.

I agree with meauxna, for us waiting for our already approved cases to be re-adjudicated it is very frustrating, my husband is a US Marine, and is stationed in Japan, however he will have a duty station change next month and now our well planned timeline is all f##$%&d up..nothing he can do either, he has to move when the military gives the orders. Lets hope the name checks go quickly, he obviously (as a Marine with security clearance) has no criminal record whatsoever!

I have another question I hope I can get answered.
If DCF is no longer available for some of us, and we go with filing in the USA, is it possible for the spouse to come to the USA on a visitor’s visa?

What I mean is can they come to the USA on a regular visitor’s visa and then return before the end of the visa or are they limited in the way they can enter the USA after the I-130 is filed?

I would be willing to pay for a round trip ticket for my wife to visit me to reduce the time spent away from each other. She would return to Japan before the visa ran out; especially since she would have to complete the process at the Tokyo consulate.

I am glad that I found this forum since it is very helpful and the members are willing to share their knowledge.

I don't think Seoul is adjudicating Japan's I-130s. I read somewhere here in the DCF discussion (I don't remember now which thread it was) that Tokyo boxed up and sent all their pending petitions to California, and the Tokyo embassy website is instructing all current petitioners to send their petitions there as well.

Well, I checked the other threads and found that California is not where Tokyo had sent the pending petitions, but it was Bangkok.

Seoul USCIS is a sub-office of the Bangkok USCIS, and it seems they accept petitions only from USCs in Korea. My guess is that Bangkok is swamped, thus Tokyo is telling USCs in Japan to file in California.

Even if she gets a visa, there's a chance she'll be turned away at the border by immigration officers, but some have had success in this. Check out this topic: B-2 Tourist VISA while awaiting DCF - APPROVED!!!

Some of the other threds have asked this question but yeah it is no problem. . . . the only thing you need to watch out for is that you dont break any obvious laws like overstaying her visa and so on. otherwise it will have no effect.


As for the other discussion about bangkok and Seoul I dont live in Asia but Rome accepts applications from countries in its jurisdiction if the suboffice wont acccept applications from outside countries (like Seoul and Japan).

The wait seems to be shorte than in america but longer than normal DCF.


Im gonna hold out for another 2 weeks to see the verdict on DCF and if it looks like its sadly been buried then Im going to file with Rome
