Are there any other K-3 February filers? I sent out the I-130 for my husband on 02/05/07, USCIS received it on 02/08/07 and I'm still waiting for the first NOA. I am not the patient kind so I hope that by reading your timelines I can feel better about all this waiting.

02/07/07 received I-130 at VSC
02/08/07 NOA1 date
02/14/07 received NOA1 via mail
next week planning to file for K3
I guess you should receive it next week,I've heard taht vermont is a little bit faster than the others so you shouldn't be worried

all right!! Feburary filers... what kind of information for #7 (the new rule addition) did you guys/girls add? I wanted to find out the "proof of ongoing marriage" and what you included.. (tickets, receipts, pictures (wedding and others), phone records??) I know that all this stuff was supposed to be for the final interview.. but the new rule in #7 wanted proof right now..
please help

The only proof I sent were 2 affidavits signed by my mother and sister explaining how they knew about the relationship and that they were witnesses of it being real and legal. They also stated that they fully supported us being together and all that other mushy stuff. Item #7 of the I-130 asked for property records or bank records with both our names on them, so I couldn't send them since my husband and I don't live together yet. If they ask for an RFE, then that's when I'll send in the pictures, plane tickets, phone records, etc. to them. Hopefully not since that'll delay the process even more.

As a proof we sent a lot of staff
pictures from our wedding day,even DVD with the wedding
the only one picture that we had showing that we knew each other before the wedding
2 affidavits from friends stating that they know about our relationship and were present at the wedding
a property record with both names on-that we pay the rent together
a couple of emails that we used to write all year long,but they are in Bulgarian so I don't know if they are worth

I was wondering if I could create a joint account at her country (China) when I go back in March.. That would also add to the proof.. I guess some wedding videos/photos and the affidavits (that is #5 under the #7 rule).. there are total of 6 things you can do under #7.. most people can go with #6 *** Any other relevant documentation to establish that thereis an ongoing marital union. ***

The instructions appear to allow for affidavits from related parties, as they state to include "his or her relationship to the petitioner or beneficiary, if any." I think it's a good sign that the family is willing to give their affidavit.

We sent in an affidavit from one of the witnesses of the ceremony.
received the 130 NOA pretty quick...still waiting on the 129f NOA

If you are not yet married why don't you just go for a K1?As far as I know it takes about 6 mounths but the chance of getting it faster is much bigger rather than if you go for a k3.If you plan to get married in March you'll waste another 1-2 weeks until you get he proper documentation ready,so you are not gonna start the K3 process before April,and K1-you can start right now.
Besides,for both you have to send the same amount of evidence (as if the marriage certificate doesn't say you are married

)

Hello everybody!
My husband has sent our I-130 petitions /for me an for our child/ at 15/02/07. He has sent as an evidence of ongoing marriage only the birth certificate of our child.
I think this is sufficient. What do you think. Is it necessary to send other proofs /photos, tickets and etc./ when we file for I-129F.

Rings (my wife) filed for us on the 15th Feb, petition was received at NSC 16th Feb, we are waiting for our NOA1. For evidence we used affidavits signed by her friends and family. Not sure what to expect but we'll let you know when something happens.

I filed for my husband on the 18th. It was the soonest we could do as I was in Finland for the week previously, as it was the time we had planned on doing DCF
Then the documents he mailed me in January didn't arrive in the US until after I left....but anyway. Now that the long weekend is over, VSC should receive my I-130 today. I have nearly everything together for the I-129F, except the payment, and will send that off AS SOON as I get the the NOA

Seems like everyone is in the same boat now.. I hope everyone has good luck with their applications.. as for going for K-1, I can't go that route because she was already married before.. I thought that you can only do K-1 when you never been married.. Also, the US government crack down on people from Asian countries

so applying K-1 would make them suspicious of her.. and I really wouldn't want that to happen

a lot of the stuff is "made in China" anyway, so why can't the people be too?

I still don't have my NOA1 BUT... I'm sure it's in the mail???

Are you checking your status online?
I just checked with the USPS tracking system and found my petition was delivered on 2/17 at 9:28 am. Odd that they deliver on a Saturday, but whatever

Is the additional proof from part 7 always required? Is it required for both I130 and I129F petitions? Also if it isn't sent does it mean i will get a RFE?
I spoke to a lawyer before i started the I130/I129F petitions for my wife and the lawyer told me i don't have to provide additional proof beside the normal requirements (Marriage Certificate, Passport Photo, and G325A) when i file for I130 but my wife will need to provide it when she goes for her interview.

Yea, it's required now as of December 2006...they always have to make it harder it seems.

I haven't been able to check my status online since I don't have a case number assigned yet. I read somewhere that they write your case number on the check but the copy that my bank has of the check online is really blurry so I can't see it.

I just checked the I-129F form and it doesn't really say that you should send proof of marriage. It does say proof that you have met before filing, so I think the marriage certificate and other evidence should be submitted.
As far as the I-130, I noticed that you received an NOA1 already so I would wait for them to send you an RFE regarding documentation. What do others think?

That's weird,we had our NOA1 date -02/08/07,received the actual receipt on Feb,14, bet check hasn't been cashed yet-you see every case is different

haha, it says YOU SHOULD, then they SHOULD give you a visa.. haha.. but that's not the point.. it's better if we send in a lot of things for proof, and not just try to send in the minimum... but that's your call

you might get a RFE, you might not..

Still no NOA1 in the mail but after staring at my cashed check for like ½ hour, I figured out the chicken scratch of my receipt number that was written on it. Went to the USCIS web site, plugged it in and lo and behold there it was. It says they recieved the I-130 on 02/14/07 and that a notice of action was mailed out to me. Uhmm... it's now 02/23/07 and still no NOA1. Called customer service and prompt says to wait 30 days from date it was mailed out. Sooooo... 03/14/07 it is, that's if I don't get it sooner. And I need it so I can submit the I-129F ASAP.
Bummer.

Concerning the I-130 form... I used the one that expired on 01/31/07 which did not have the extra proof requirement attached to part 7. Since no question was asked no extra proof was sent. Hopefully no RFE. Checking my NOA1 it was recieved on 01/11/07 so we barely made it on the time frame.
I-129F was sent on jan. 30 and the NOA1 was sent back on Feb. 5th. Now is has been transferred to CSC. Both checks have cleared. Still waiting for the I-130 to get touched.

My timeline is pretty much the same as your climo. I sent my I-130 before the 1/31/07 form expired, so I didn't send anything addtional which seems to be required now.
Looking at people's timelines, I would expect the I-129 form to get touched more often than the 130.

Our check was cashed on March 2nd after USCIS-CSC received the I-130 on Feb 28th.
Waiting for the NOA1 hardcopy so we can send in the I-129F....

hi my husband filed on the 9th of feb 2007 for the I-130 and we got the NOA1 on feb 17,07. you should here from them soon!

Hi. If you have not received NOA 1 a month after USCIS has received your I-130, you should to call them and to find out what have happend. May be there is something wrong. They will resubmit it.

Thanks Kalina, that's exactly what I plan on doing. I'm waiting for my 30 days to be up so I can find out what happened with it. It sucks that I can't file my I-129F without that piece of paper.

i think u need to send proof of marriage but , not sure
coz i never tried the i-129 route
but whatever the waiting will take anywhere 3-6 months for the noa-2
also you need to have all pics and all and marraige certificate for the real interview
why dont you send it before itself
i dunno much but feels like only birth certificate of child might not suffice the criterion for them
its better you call uscis toll free no. and verify

I also a February filer.
Here is my time line so far.
I-130 Sent : 2007-01-31
I-130 NOA1 : 2007-02-05
I-129F Sent : 2007-02-10
I-129F NOA1 : 2007-02-21
My I-129F has been transfered from MSC to Vermont on March 2nd and waiting for the transfer receipt in mail.
I do have one question about the transfer status. Does the Vermont Service Center send a notice or the USCIS website updates to show that the petition was received and processing? If not how can i find out about the status of my petition?

Talked to my husband just a few hours ago and we have decided to dump the K-3 visa process and choose the CR-1 route instead. We still haven't received our NOA1 from the I-130 and someone told me that after I call, it will probably take another month for it to arrive. By the time we file the I-129F and get our NOA1 from CSC, we would probably have lost about 2 months of the K-3 visa process. I hope we're making the right decision and the CR-1 doesn't get stuck at the CSC for months like I've seen other people's. This whole visa process is just too much!.
