We applied for AOS in December but did not foresee any of the situations that we are now in. My husband is not able to drive, because he needs his EAD or Greencard to get a Drivers License.

More serious situation, is that we found out his father has been diagnosed with cancer, and it is too advanced. My husband may have to leave the country.

You can file for AP and EAD now or if an emergency situation happened you could file for emergency AP at your local office as long as you have evidence of the emergency.... (fax from a hospital/funeral home or fax from a Doctor)....

Your husband must not leave without the AP or you will be abandoning your AOS.... and he will have to remain outside the USA while you file for a K3...

Thank you, Kez. I think I will apply for AP and if he needs to go I will then make in infopass appt.

I am stressed about all this. Now, should we efile for EAD, will it still take 3 months, or should we just wait to see if we get GC?
