Full Version: DS230 STUPID QUESTION??
VisaJourney.com > Marriage Based Immigration (K1, K2, K3, etc) to the USA > IR-1 / CR-1 Spouse Visa General Discussion

Robee
I will be cutting it close on the 2 year mark. If I generate the coversheet (james shortcuts) with a IR1 code rather than a CR1 code will I create a problem? I am hoping that if my wife gets here before the 2 year mark (a month early)she still gets the 10 year green card.

thoughts?

My understanding is that it is the date of marriage when entering at the POE that matters, so doing CR1 should be fine.

That is not my question? My question is if I place IR1 on the documents rather than CR1 will I cause any unnecessary delays. The problem is that my wife is pregnant and I will bring her here the moment that the documents are finished. We were married June 5, 2005. I might just miss the 2 year mark.

All other documents were filed under the "conditional code".

I'm pretty sure I understood the gist of your question, but I would personally continue to put CR1 on any generated documents because that's what you would receive anyway... what I meant to express is that my understanding is that it does not matter how long you were married at the interview, but instead how long when the beneficiary enters the U.S. --- so the visa could initially be a CR1 but then be an IR1 upon entry.

Hi,

Robee....don't put IR-1....just stay with CR-1 on the papers. Since the 2 year mark has not been reached yet you are still filing for CR-1 not IR-1. They will change it automaticly if they feel the date is close enough. Oh..by the way....nice anniversary date (june 5)...thats my birthday...smile.gif
