1) I was told that DCF has recently been terminated. Is this correct?

2) Is DCF good only when you (the petitioner) live in the same country as you fiancee (so that you can file the DCF at the US embassy of your fiancee's residency)?
I'm a US citizen currently working overseas and my fiancee lives in a different country (China)

1) DCF has changed drastically. Is it dead? For the moment it appears to be but the rumor mill is full of conjecture about its revival. It is still a very fluid situation and new information becomes known each week.

2) DCF has always been about meeting the residency requirement of the consulate you are applying through (residency of the non-USC spouse most typically). The residency requirement varies from country to country and it could be from 30 days to 2 years or longer. However, some consulates have been known to "waive" the residency requirement. Since the situation is still in flux it is hard to determine what will be the final outcome. When things settle down you will need to find out all you can about the consulate you will be processing through.

If everything were as it had been, you would still not be eligible for direct filing. The residency rules in China have always been very strict (very high immigration numbers coming from China--one IV issuing post).
Since you are not a resident in China, youi would not be eligible to file there. Some countries did allow filing by non-resident USCs, but China was never one of them.

This is the time to research your other options.

also - its not necessarily just having residency in the place you want to file your i130

my husband and i were going to marry on the beach in thailand....however the rule to file dcf in idnia was 90 days stay AND marriage had to take place in INdia.

so check on that also
best thing to do is contact the embassy nearest to you

in delhi they have a window thats open 1 hour a day (window 17 from 2-3pm i think)
anyways - you can go and ask any questions
see if your emabssy thats in china has this too and go ask them all your questions
its best to get it directly from them
