I have contacted my US Consualte General in Naha, Okinawa, Japan, and they said it was just a rumor that DCF was back...Im hoping and praying the US Consulates abroad will be able to process the applications again, as my I-130 was already approved by them in December 2006 but because of this new law, any approved I-130 between July 2006-Jan.23 2007 had to be sent to the USCIS to be reapproved...I of course had my medical on Jan.22nd and went online to book my final interview on the 23rd...had I known...had I known...I could have had an interview earllier..to avoid this frustration and heartache...my husband is a US Marine going stateside next month and I wasnt told much from my US Consulate here besides maybe I would have to wait in Japan for another 12-18 months...I am Canadian teaching English here (have been a resident here for the last 6 years) and my husband was stationed here with the US Marine Core so we both got married in Japan and proceeded with the DCF processing so that I could move with him to his next duty station...not goin to happen now....but im keeping my fingers crossed about them reversing this DCF law...surely my Federal RCMP fingerprint non-criminal police certificates & name based police certificates and same type of Japanese police certificates should prove I am not a sexual offender...Japan has been giving me a work visa for that last 6 years to teach children in the public education system here...its really not fair whats happening...so much for planning...any updates on the DCF with US Consulates abroad would be greatly appreciated.

The background check needs to be completed on your husband. They will need to do a background check for the USC / petitioner.

Just hang in there a couple of weeks and see how things settle - it really does sound like DCF is getting reconsidered, although what will happen to the petitions which are currently in process is really unknown (try calling your local USCIS office rather than the consulate - they seem to know MUCH more about what is going on)! And just to clarify something: this new law is to check the petitioner (your husband) for criminal background, not you. I really hope you can still keep all your plans and stay with your husband.

I would agree just be patient a little bit longer. This mess has caused a lot of confusion for people both on the inside and on the outside of this whole process.

This is the reason I have been trying to be very diligent about posting any news I recieve from the inside as soon as possible.

There is a lot of truth to the fact that DCF is comming back. I know this confusion has caused a lot of Consular sections and USCIS offices to start giving out conflicting info.

But the last bit of word I got does make it sound like it has been decided to bring DCF back. It just seems like they are hammering out some final details before sending out the full official word about how things will be handled.

I would say just be patient a little while longer. I'll keep posting any more news I can get both good and bad.
