Full Version: written affidavits?

I've just made it through the instructions of the I751 form and it states there that written affidavits may be presented as proof of a valid marriage. blink.gif
I find this a bit strange and would prefer to not having to ask any of our friends to prepare something like this.
Do you think this will be one of the more important evidence documents?

We don't have children so we can't present birthcertificates or the like, but we have a few things shared like bank account, insurances and property. We also don't have bills in both of our names (the companies we work with won't issue in both names).

Do you think we should include affidavits?

It's a good idea to include as much as physically possible - the guides suggest that the affidavits are considered major evidence as they provide specific testimony from identifiable people who can attest to the authenticity of your marriage.

The form doesn't say that they are compulsory, but better to be safe than sorry.

They helped my friend get her GC. The proof she provided was deemed not enough, so she went around and got affidavits from friends and even the mayor (she knew him from her work as the editor of the local newspaper). So if you can, I'd get a couple to add to your packet. smile.gif

Thank you all for your replies smile.gif I guess we will go around and ask a few people to write something. Even if it's strange... but oh well.

You do not have to have all of the types listed below as proof of the relationship, just supply as many as you can. If you are short on the documents that have both of your names listed on them you MAY include affidavits from people who know you as a couple (see examples), confirming your marital relationship -- note that they are not required. If you have very little documentary evidence, you may find affidavits helpful.

I personally do not think affidavits are always appropriate. I didn't want to ask people to do it either, and I researched several opinions including 2 immigration lawyers' before I came to my conclusion. Our I-751 was approved without interview.

Other people have had plenty of documentary evidence and included affidavits and been approved without interview.

One lawyer puts it something like 'if you don't have anything else, bring affidavits'.

I didn't include any affidavits in our package either... I didn't want to have to ask anybody to write one.....

I am pretty sure we have enough proof though....

If you have a reasonable amount of other evidence, they won't be needed. We didn't use any and had no problem.

All I submitted were affidavits, nothing else. Affidavits hold up well in court. I wrote out the affidavits and had two friends sign them in front of a notary. But that was quite a few years back for a prior marriage.
