i was wondering if anyone can answer this for me or is in a similar situation, i can't seem to find an answer on the irs website... my husband is here on a K1 visa and we are currently filing the adjustment of status, in the meantime, can i claim him on my tax return. we got married in november and i am sponsoring him. i know we are supposed to file jointly for immigration purposes but i am not sure what to do.

ok, i am going to answer my own question and hopefully it will help others who may have had the same question... i just spoke with my friend's husband, he is an accountant, and he said as long as my husband has a ssi # than we should file jointly just like any other couple. he said if someone is waiting for the ssi # than wait until closer to april 15 if you will have it by then.

If your husband does not have a SSN, he can apply for an ITIN (individual taxpayer identification number) to use on your taxes (we did that last year)... all you have to do is file a W7 (i think..t aht's what it was last year) with your taxes, and then you can file as soon as you want.. but yeah, if he is going to get a SSN in the near future, you should wait for that since it will make things easier next year as well.. (couldnt efile this year since my numbers didn't match)

thanks for the information, he does have a ss# so i filed the taxes over the weekend (one more thing out of the way!!)
