I’m not intending to start a huge controversy, but I remembered a comment about a K1 nonimmigrant (beneficiary) and gun ownership on a different thread.

I think the K1 will need to be adjusted to immigrant status before the person will be able to purchase and/or legally own a firearm.

Here is what I located on the web from:

I’m not sure if I have all the up-to-date information.

Anyone who thinks that gun freedom to the extent the NRA advocates is under the Constitution has a lot to learn about U.S. history (understandable if you are an immigrant). BUT, there are many reasons people have guns, and people should be able to have them if necessary, IMO. I am not for gun control to the extent that nobody can have guns. I just think the restrictions on who can have one need to be strong.

People who might need to protect their horse from a coyote (problem in MN) should be able to shoot the coyote, for an example.

When are men compensating when they have a gun? When they have a million guns and don't stop talking about their huge unnecessary arsenal and their fascination with it. They're compensating for something, and it might not be the obvious thing.

Anyway, back to guns, Natty, as far as I'm concenrned only US citizens are eligible to buying/owning firearms, right? So an immigrant that has US citizenship can buy/own guns.

I think they are mistaking getting their right to bare arms. But ok, is there a war going on here in the US? Um, no... so I donnot see why people need guns at home, unless you live in like let's say North Oakland or Compton....

I’m no expert on the subject. What I think the words indicate is a person will need to be a USC or hold an immigrant visa in order to legally buy/ own firearms. The K-1 is … correct me if I’m wrong … a nonimmigrant visa. After the marriage, the K-1 holder adjusts status and eventually becomes an immigrant (LPR, USC, etc).

This law covers the legal ownership. Of course there is “illegal” ownership where the person who is not entitled to buy/ own … does … buy/ own via not legal methods. When they do this they are breaking the law and are subject to a “world of hurt” if caught by law enforcement.

Here is the ATF Form 4473 that must be completed by the purchaser of a firearm. On Page 3 there is a section covering Immigrants and nonimmigrant. It appears there is an “exception” for nonimmigrant status. Looks like one of the exceptions is a “State issued hunting license” (page 3, section 6, exception 2).

So, looks like I need to make a correction in my earlier statement. Please read the form. You may need to lookup the file in a better format.

Hmm... most of the men in my family have served as officers and none of them are very interested in guns at all. They all know how to use them and lots of other weapons, but their interest in the weapons seems to end when they enter civilian life. Weird. Maybe it is a Kansas thing (what else are you going to do out there?) smile.gif

Well in my case I'm not a citizen, I'm not even sure I'll ever apply for citizenship, so I can't own nor buy guns. But then again, I live in a house full of them, I have access anytime. If someone breaks in nothing stops me from shooting them. I don't know if that will get me in trouble, since I am not allowed to own guns, but I won't think twice if such happens, I'll shoot.

I think something was missed. There are exceptions for nonimmigrant visa status so you may actually be able to buy/ own. But you've got a "house full" so that's probably not an issue. wink.gif I would like to suggest a firearms safety course to take the "mystery/ hollywood hype/ fear factor" away. Basically, just learn to be safe.

There are probably courses for fiream safety in your area. If it’s a good course they will have someone instructing or available to answer your more detailed questions, particularly about self-defense.

Also, not only do the Federal laws need to be followed, you also need to follow State (local) laws as well. Can’t speak much about TX or KS provisions as I’m a recent transplant from VA.

18 USC § 922(y)(2)

(y) Provisions Relating to Aliens Admitted Under Nonimmigrant Visas.—
(1) Definitions.— In this subsection—
(A) the term “alien” has the same meaning as in section 101(a)(3) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(3)); and
(B ) the term “nonimmigrant visa” has the same meaning as in section 101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101 (a)(26)).
(2) Exceptions.— Subsections (d)(5)(B ), (g)(5)(B ), and (s)(3)(B )(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that alien is—
(A) admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;
(B ) an official representative of a foreign government who is—
(i) accredited to the United States Government or the Government’s mission to an international organization having its headquarters in the United States; or
(ii) en route to or from another country to which that alien is accredited;
© an official of a foreign government or a distinguished foreign visitor who has been so designated by the Department of State; or
(D) a foreign law enforcement officer of a friendly foreign government entering the United States on official law enforcement business.
(3) Waiver.—
(A) Conditions for waiver.— Any individual who has been admitted to the United States under a nonimmigrant visa may receive a waiver from the requirements of subsection (g)(5), if—
(i) the individual submits to the Attorney General a petition that meets the requirements of subparagraph ©; and
(ii) the Attorney General approves the petition.
(B ) Petition.— Each petition under subparagraph (B ) shall—
(i) demonstrate that the petitioner has resided in the United States for a continuous period of not less than 180 days before the date on which the petition is submitted under this paragraph; and
(ii) include a written statement from the embassy or consulate of the petitioner, authorizing the petitioner to acquire a firearm or ammunition and certifying that the alien would not, absent the application of subsection (g)(5)(B ), otherwise be prohibited from such acquisition under subsection (g).
© Approval of petition.— The Attorney General shall approve a petition submitted in accordance with this paragraph, if the Attorney General determines that waiving the requirements of subsection (g)(5)(B ) with respect to the petitioner—
(i) would be in the interests of justice; and
(ii) would not jeopardize the public safety. [APPENDIX A Repealed. Pub. L. 103–322, title XI, § 110105(2), Sept. 13, 1994, 108 Stat. 2000]

We have talked about me taking a firearm safety course, but we keep postponing it, since we have more important things to do, I'm starting to adjust here, plus we don't expect anyone to ever break into the house, since we live in a pretty safe place, but you never know. As for my comment on having a house full, it was a bit exagerated, but you see my point. We also have baseball bats and plenty of knives lol tongue.gif

Val has always been scared of guns all of her life. We went shooting this weekend out in the desert and after that first time, she loved it - she had a BLAST tongue.gif . She and her son loved the 22's but didnt want to shoot the high cal rifles.

You are wrong, Permanent Residence can purchase the same fire arms as US citizens. I think guns are a great lot of fun when used by responsible people.

the options given are ridiculous! Women own guns as well so its not men compensating for anything, the op is just anti guns.

You are wrong, Permanent Residence can purchase the same fire arms as US citizens. I think guns are a great lot of fun when used by responsible people.

There appears to be a few of us who shoot and have Brazilian SO's.

Isabela’s experiences with firearms have been … well … to be kind … not very good. Before me, firearms not in the military were all about “candy men”, bad men, gangs, TV (Hollywood), etc. Not a good image.

She realizes that I actually enjoy BPCR & Creedmoor style shooting with my Sharps (there is something about using 100+ year old technology, BP, and techniques). All she asks is to be safe and keep the home safe. This isn't a problem for me.

So, to put this thread on an informative note:
How was the adjustment for your SO, from another country with potentially diametrically opposed views, into a home with responsible firearm ownership?
Any problems?
Compromises?
Educational moments?
Hopefully this topic was well discussed before arrival of your SO and it was just the mental adjustment of knowing there were firearms in the house.

education occured before nessa came to the states. she'll be taking a firearms safety course soon anyways.

nessa's always known i own guns and fortunately for me she's interesting in shooting too.

bar length can be a problem with balance point and handling for her. what about putting a 14" or 16" on the saw? I swap bars depending on the work to do and the shorter bar makes a difference. tongue_ss.gif

bar length can be a problem with balance point and handling for her. what about putting a 14" or 16" on the saw? I swap bars depending on the work to do and the shorter bar makes a difference. tongue_ss.gif

actually the 20" isn't much heavier than the 18" i used to have. plus the length of the bar balances it pretty good. i went with 20" chain saws as they seem to cut faster plus i only need one size chain (used to be a real pain looking for a chain when i had a 14", 18" and 20" laughing.gif
