Full Version: help!!! fast!!! immigration asking for documentation of leaving the US after visa approved!!

hello friends,

my husband was awarded his k3 visa at the consulate in fiji on the 23rd. he now has visa in hand and is ready to fly out tonight but someone told him he will need to buy a plane ticket showing he is leaving the united states, because the k3 visa is not a residency visa. does anyone know anything about this?? is there any proof that can be shown so that he does not have to buy the plane ticket??? needless to say we cannot afford to buy one right now after a very costly move...he has a ticket to return to australia as an absolute last resort, but that is not what we want!! was the immigration officer simply out of the loop?? is there a way to get permission from the embassy to fly one way?? what is needed? thank you sooooooo much for your help!!

He doesn't need a return ticket to enter on a K3. A K3 allows him to enter the U.S. and live there while waiting for his AOS.

I agree... he does not need a return ticket.... he is good to go...

and I also agree.......we came in to USA on one way tickets!

My wife entered from Colombia with a K-3 visa and a one way ticket. No problemo...

Agree with the others, it's not an issue.

The K-3 is technically a non-immigrant fiancee visa, but it's for immigrating spouses. I swear I'm not making this up. Immigration law is such a mess!

Most non-immigrant visas require that the alien demonstrate non-immigrant intent, by showing that their stay will be temporary and that they have the means to return after their temporary stay is over. So most people entering on a non-immigrant visa would probably need that round trip ticket, which is probably the source of the rumour you heard.

But since the K-3 visa is a special kind of non-immigrant fiancee visa intended for immigrating spouses, it's not subject to the requirement that the alien show non-immigrant intent. They fully expect him to stay in the US indefinitely, and a one-way ticket is fine as far as immigration authorities are concerned.

Also shop your different ticketing options. Sometimes round trip is cheaper. Also; depending on when you plan a return trip, it may be possible to use the return trip at a later date. Of course you have to purchase the correct ticket up front.
