I have a question:after divorcing after AOS,can a beneficiary still obtain US citizenship?

To answer your question if I understand it correctly,I now had to file for a fiance visa because I have been out of the US for more than a year and during this time frame, I met my fiance. Now, my previous history goes like this:

My mother and I received a permanent resident card in 1983 when my mother married my stepfather. My mother and stepfather have been divorced since the early 90's and she was allowed to remain in the states. So, therefore, once you get divorced, you don't have to leave. Now I don't know if there are certain stipulations though. I can imagine that if you divorced pretty fast after receiving a Visa, it will get looked at suspiciously, and there may be a risk of getting deported or whatever. I'm not sure about the stipulations though. I just know that my mother stayed and i stayed as well. Matter of fact, I lived in Texas from 1983-2002.

If you get divorced after receiving your green card, you can still apply for citizenship. However, you will have to wait 5 years (instead of 3) from the date you first got your green card, before you become eligible to apply for citizenship.

The simple answer is yes, provided you meet the eligibility requirements, under Section 319 of the INA.

Depending on when the divorce happened, when the marriage happened, and some related circumstances behind it, there might be some difficulty in removing conditions. If conditions can't be removed, then the alien won't be able to stay in the US with LPR status for the full five years necessary for citizenship.

But if the divorce happens after conditions are removed, or if there is sufficient evidence that the marriage was originally entered in good faith and was a bona fide marriage despite the fact that it eventually ended in divorce, or if the LPR status was never conditional to begin with (because the marriage was old when LPR status was gained) then the alien can keep LPR status long enough to become a citizen.

You don't need to be married to become U.S. citizen. It's not a requirement smile.gif

In addition to my above post:
You only need to remain married if you want expedited citizenship after 3 years of residency. Otherwise, after you have removed conditions (if there were any), you no longer depend on your spouse for your immigration status, and you can file for citizenship after 5 years.
