How do you acquire proof of a bona fide marriage before you get a K3 Visa? How can I add my wife on my bank accounts if she does not have her visa yet or a social security number? I own my own home and all my utilities are in my name also, should I have her added to all my utility accounts and anything else I can before she arrives here or is that even possible?

This is a new requirement, and unfortunately it's causing a lot of stress!!

The consensus seems to be to provide the evidence you can (particularly the affidavits from people who know both of you) ... the immigration laws prevent us from living together in the U.S. so it's unreasonable to expect us to provide evidence that comes along with living together such as merged finances. Some of the suggestions make more sense if the I130 is being submitted in conjunction with an I485.

For the K-3 a marriage certificate. All the other items you are mentioning will be needed for your I-485.

You might want to read the new instructions for the latest version of the I-130 petition to see what might be behind the question. (Although, Gaby&Talbert has already submitted the I-130 petition so I wonder why they're asking this question now.)

One way is the way that I did it - I went to my bank, they gave me a signature card, I sent the card to my wife, she signed it and sent it back to me, and I turned the card in to the bank with her passport as ID (she had sent the passport to me also as ID needed to get her an ITIN).

The bank needs a SSN for only one person on a joint account, so that they can report any interest earnings to the IRS.

If your present bank has imposed stricter than necessary requirements for compliance with the Patriot Act you can look for another bank to do business with.

If someone is just filing the I130 in order to have the K-3 go through and is not going to pursue the I130, would any of this matter? The I130's approval does not relate to the K-3's approval does it?

An approved I-130 is necessary for a K3 to adjust status. So just because a K3 does not pursue an immigrant visa does not mean that the I-130 is moot.

Only because I am appying for a K3 visa and I assume this is the correct forum. I read some posts that this was required and on the Juarez Consulate website and it said for marriage it was needed. I read some posts from interviews in Juarez and they said they did not ask for this information but I want to make sure for the interview that I have anything they might ask for. I am just trying to be prepared.

Is it possible you've read about interviews for Adjustment of Status or Removing Conditions? Such evidence is required at those interviews, because those couples are already living together in the U.S.

It can't hurt to have evidence at your interview that shows you have a valid marriage, but evidence which can only come from living together can't be expected smile.gif Good luck!

Right, but once you get to the adjustment of status then you'll have a heck of a lot more proof that you're married i would think, such as adding his/her name to the utilities, phonebill , etc.

Or are you saying that he'd definitely need an approved I-130 to even come to the US?

I'm saying that pursuing an immigrant visa should not be called "pursue the I130". Petitions and visa applications are two separate things.

Again, adjustment of status requires an approved I-130 (except for K1s who marry within 90 days of entry), so I-130 gets pursued one way or another.
