Full Version: I-134 Sponsor Question

Well our plan for the I-134 is for Sam and his daddy to be co-sponors for me to the US, but I am wondering if it is ok for someone other than the visa applicant to be the lead sponsor. What if Sam was not involved in the I-134 and only his daddy is the sponor, is that ok? Just as long as its proven that I wont become a public charge do they care who is the sponsor?

I don't think it matters who the co-sponsor is, just as long as they meet the income level. Sam will still need to fill out the I-134 as well as the co-sponsor.

What I mean is what if the only sponsor is his daddy, Sam wouldn't be involved in sponsoring me in any way. The only one to turn in bank forms and income amounts would be his daddy. Is ok if Sam is not part of the I-134?

Both have to provide completed I-134 and financial documents the consulate level is different because the "CO-Sponsor" is agreeing to support during the time between entering country and adjusting status, after that Sam is the primary sponsor for AOS and his father can be the joint sponsor.

The consular officer at the interview will give you a blue slip if Sam fails to provide an I-134.

Sam must be a "part" of the I-134. His daddy will be the co-sponsor. If Sam doesn't have any money, then he should reflect that on his I-134. If he writes $0 for everything, then he need not prove anything. His daddy will write an adequate amount (125% of poverty level, I think) on his I-134 and back that amount up with the necessary paperwork (last year's tax return, paystubs, bank statements, etc). Sam, in essence, is showing nothing in terms of financial support but he still must fill out an I-134 because he is the fiance that is sponsoring your K1.

The note under the general information about this form states:

Note: If the sponsor is married, the affidavit should be signed jointly by both husband and wife. Affidavits of support are unacceptable if more than one year has elapsed from the date there on.

From answers on a previous thread, I was under the impression that only one co-sponsor could sign the form. These instructions imply that if the co-sponsor is married their spouse must also sign it. (I might add here that the form does not lend itself to two signatures.)

Case in point: Our daughter's Canadian fiance will need a sponsor since she currently has no income (She is a student.) As a married couple do we both need to sign the I-134? We both work and either of us have earned income sufficient to be a sponsor. I thought I understood it all but this note at the bottom of the general information is confusing me again.

I dont think so...as he was your petitioner not his dad

I should be OK, as long as the consular officer feels comfortable that Sam's dad will actually provide the support he promises should it be required.

Note that you, not Sam are the visa applicant.

Not necessarily. There is nothing in the INA or in the DoS' FAM that indicates that the petitioner must be the sponsor, or a sponsor, of a K visa applicant. The same rules apply to K visa applicants as to any other non-immigrant visa applicant - if the applicant does not have sufficient financial resources of their own then they need a sponsor who will promise to provide any necessary support.

True, the petitioner is the most reasonable first choice for a sponsor in a K-visa situation, but nothing says who that sponsor must be.
