Full Version: Last name change after Green card

Peter
Hey Guys,

I moved down from Canada, my wife is the US Citizen. When we filled for adjustment of status, at that point she didn't change her name to my last name. Now, We had time to change all that ( Her nursing license, drivers license, etc etc), and i'm a little worried.

Since the AOS was filled in her maiden name, can I still file the Removal of conditions under her Married name? I know I'm the green card holder and it shouldn't REALLY matter as long as its the same person but looking for some feedback here.

I was thinking abotu writing a simple letter explaining that she didn't have enough time to change her name that quickly due to nursing license taking this and this long. Thats why she used her maiden name on AOS and her mrried name on Lifting the conditions.

Thanks
Peter

As long as you are still married the the person who sponsored you and she has current ID then it is not an issue... it is only if you the greencard holder wants to change your name that you need to file forms with USCIS... just make sure you include evidence of new name with the forms for removing conditions...

Good Luck

Oh,

I figured it wouldn't really matter as long its the same person. I Guess i can always include a letter stating taht the sponsor changed her name to her new last name because we had time/funds and etc.

She changed her last name to yours. That seems like it would be a point in your favor demonstrating that you have a legitimate relationship.

I would make sure when you reference the name change that you include your marriage cert, which would be the document that "links" her maiden name to her married name. I know you already submitted this, but it helps to have it right there.

Good luck!

when I got married, I changed my name too...

I have my husbands last name...since then. My SS, all my papers are married name, and
in the petition where they ask for alias , I always put my maiden name...so
they can link one to the other.

Now, I think...that is funny, because my passport is in my maiden name.....and
my US ID's are all married name...It is a bit confusing , I wonder how people track back. Oh well.

this is not a problem anyway.
