Full Version: Traveling on K3 Visa? Help please!

Hi,

My husband has his K3 visa since October and we came to states in Oct and have been living here since then, we filed the AOS and the EAD so he can start working and get his green card, sooooo my question is this..

K3 has M for multiple entries, and one of the reasons we thought it would be better to get married first and do k3 instead of k1, but I think i heard that you cannot travel out of US on the k3 after filing AOS, which does not makes sense since he has multiple entry visa. We are going on a cruise to Cozumel and want o make sure he can get back to US.
It is however entirely possible we will have the EAD by Feb 8th, does that help or meann anything for traveling.. i really thought K3 Mulitiple entry means Travel is fine.

We would have just gone as I never saw or read anything about having to do AP for k3 Mulitiple entry visa.

Anyone no for sure on this??? or have comments ideas or suggestions!!

Funnily enough, I have the same question? We were looking at going for a cruise to mexico as well. My K3 expires in September and my AOS is still pending.
We have talked about it and just are not sure what the story is. Unfortunately any inquiries I have made with the disinformation line have been weird and varied. yes and no answers from them so Im not going to risk it until I really know for sure.

I actually work for a cruise port and my husband use to work on a ship so it is indeed strange we don't know the answer, however same conflicting inofrmation. I can tell you this that when I have had to check foreign passports anyone with a M for entry is good with traveleing.. I am going to check with the CBP (customs border control ) on Saturday when I am at the port and see what they have to say. Will let you know.. But if anyone can answer or give suggestions I am still waiting!!!

I have a K-3 Visa and I have travelled to Canada on several occassion several times without any problems. Just a few questions at the Border and thats all!

But did you travel out of the country and have your AOS approved while out of the country? IF your AOS is approved and entered in a computer and you try to reenter with out either your green card or AP there is some potiential for problems.

I'm not an expert and most AOS involes an interview before approval, so you would have an idea of when its being approved, so you can plan around it.

However some are approved without an interview, your K-3 is still good to enter the country, there may be questions. But if you explain that the approval came without notice, while you were away....there shouldn't be a problem...

It doesnt matter, you can travel out of the US without problems if you are on K-3 and your AOS is pending as long as K-3 is valid
