I have finally been able to inscribe our Timeline, and at the bottom VJ indicates that if the 7th of Dec is passed by more than 10 days, to consider call the USCIS...also it says or per USCIS processing times...which is on their site 12th of march...

Questions

1. on which basis VJ calculates 7 déc...considering USCIS timeline...there is such a contrast in the respective timelines...
2. I have tried to know what's going on in VT...stating their 12 of march timeline that is there for months...in avail...so, i try again...in the other thread we discoverd 3 of us have been touched the same day...i don't know if it's a pattern, as i think VJ seems inclined to understand...so...if anyone, again, has any theories...they'll be appreciated...
3. finally...what to say to USCIS other than: any news about our petition?..and should we email them or call them...i believe they have given us the 1-800 number...
Thanks!

Eventhough you are 1 month ahead of me i feel like i am in the same boat with you. I have no touches and when i see people are getting approved from mid november i get upset. I do not know what to do also.

I was thinking did you by any chance applied for K-3 as well? Looks like people who applied for K-3 are getting their 130's approved faster. In my case i never applied for K-3. I am just waiting for 130 right now.

Good morning Dennis!...you seem in the same boat as us..it's good to know...and welcome !!!there are now Niagara Falls, NYC-girl and Heina...give and take 2-3 weeks of the date of application...(i have opened another thread in this forum related to Vermont)...
I'll look more into the K-3 and Ir-1 theory...We did not apply for K-3...as initially intended, seeing that or then that some were approved almost in the same time...Just yesterday i saw in Misa's timeline that she had been approved her K-3 and Ir-1 the same day...for example
Since the 3 girls, me included got the NOa1 the same day...i am more attentive about those dates and even the touches...Somewhere i have the feeling they are classifiying us under some criterias...under the type of visa petition classification...it's interesting but the waiting time is pretty too much now...and, I find a bit contradictory with the publicity about families reunions they make.(the changes made to be more customer inclined)....i don't know if it's so necessary to put them in such hard situations...this is what begins to preoccupy me...and don't know it in the long run it will be acceptable to me...

Hi, friends! I can't more to wait. I'm upset. Last Fryday my husband called to Customer Servise. The operator told that decision concerning ours cases will be made till March. If not he will call to governor or senators. The most funny thing he told that "Our site containes all comprehensive information. Visit our web-site" Ha-ha-ha. What a nice joke! laughing.gif
According to this chart http://www.visajourney.com/forums/index.ph...2024&st=225 it is our turn now.
Oh. God! helpsmilie.gif us!
Good luck, gyes!
P.S. Sorry for my English.

Nice to see you NYC_girl, courageous husband..!!!.and thanks for sharing...finally someone was active...Question: did they say why march, is it because their workload or just the case...are they in a some sort of checking our pubic hair...(lol...this is how I feel with their intrustions...) at least you have a date...Since i opened the 2 threads i have searched a lot the timelines of the cr-1's...all over the place...usually all is done in a time frame of 7 to 9 months,if not 11 months...rarelly 1year.. so we are still in the timeline..but march is a bit far...

I have also done from AILA, where they keep all the reports of Timelines of the USCIS (Vermont)...a comparative analyze with the other visas K-1 and K-3...briefly, only fastest moment: *30th june - cr-1 24 décembre 2005 and
* 11 July - cr-1 05 february 2006. A jump of 1 month and a half...almost same time as we are this year...Then, since 17 nov 2006 they are blocked on the famous 12 of march...
Also somtimes they go backwards with the K-1...of 1 month and a half also..then they take 2 months to arrive at the same month they got backwards...interesting....I don't know what it means...

Hi, knowledge! Nothing courageous. My husband did it after my 10000000 reminder. Operator said that the ordinary process lasts about 8-9 months, so that is why March (I think). K-visas are so fast because they are forwarded to embassy without NVC process. Through this process they pass at the time of adjustment of status in USA, which can be last about 2-3 years.

Hi guys i checked my status today and i got a touch this morning. Finally some activity. I will be checking it every 5 min today.

Just my thoughts on the March thing...I think I read somewhere that if you go 6 months without so much as a touch or anything, you can do a Congressional inquiry. I know our 6 month mark will fall in March, so that's what I was planning to do.

Thanks so much NYC_girl! it's valuable infos...as for the timeline of processing...it reminds me i have read that nowhere they specify a limit of time..(i.e. 6 months, etc)...i read on legal infos outside this site that that way, people can not complain to give them the time to make all the checkups they need...But, generally i think they try to fit into reasonable time frames...so hopefully all will be fine!...

I think petitioner's call their local congressman to ask them to expedite the process for an approval. Welcome at board, yes you are new born on here lol...and i think that Colombia goes fast, i remember a gent who's fiancé is from there who got approved really fast; his timeline is great...Dougcecy i think his screen name is...check on the I-130 approvals forum in this thread...

I think filing the I-129 pushes things ahead but I am not sure why. Maybe since there's less review with K3s? But that doesn't really make sense either since they are starting to approve both petitions the same day. It's as if when they have time to review the I-129, they pull the I-130 too for review. But it appears they are also retaining the approved I-130 when filed with a I-129 so something else has to be filed (along with $200) to release to NVC and we're not sure how long that takes for them to forward it.

There's another girl here, Stacey who just filed an I-129 to see if she would get approvals faster and be reunited sooner.

I feel for you all. I hope your approvals come soon so you can start the NVC stage.
Traviesa
Congressional inquiry is where you contact the constituent services office of your Representative or Senator(s) and they file an inquiry with USCIS as to the status of your case. It is NOT a request to expedite, as someone mentioned. It is simply the best way to get the most information about your case possible-they will often be more willing to speak with the Congress people than with you.

Heheh, how does it feel Misa to be touched from both sides!!!...as we 3 here have been touched the same day, ok not for the same reason (for the NOA1)..i certainly became more sensitive and think that the touches became/are important...each one is something important...Dennis for ex, was touched 2 times...others, only once before rfe or approval..i didn't see any who have not been touched before beeing approved...oh well..i just obsess laud about them...to find the meaning of this "language"....Good day and thanks for your concern...you are flying away now...lucky girl! smile.gif

If you want to do it yourself, more power to you. I've already been through this entire process for a K-1 that we didn't get so I'm a little familiar with the way things work with these people. I would never waste my time making an inquiry on behalf of myself. Let the elected officials do what I'm paying them to do...

What the hell is going on with Vermont? their timeline has been stuck on March 12 since Nov! Ridiculous. At this rate my wife won't be here until 2008. Is there anyone who has done the congressional inquiry? what does one need to do? I'm interested in doing this, can this be done by email, snail mail, phone call?

Be careful about doing a Congressional inquiry "too early." You may be turned down. I always recommend waiting until you have gone 6 months with no touches or anything. That is our plan. Then start with your Senators. Each of your Senators should have a web site. Look on the web site and find the part that talks about "constituent services." From there, you can print off a privacy release form and follow their directions for sending in the privacy release form and your request. Make sure you include your case number and VERY specific instructions as to what you want them to do. Tell them you have not been touched in 6 months and you would really appreciate information as to why your case is stuck. That if there's a problem you want the opportunity to fix it. The Senator themself does not do casework, it is done by a completely separate office. They each have their own preferences, one allowed me to fax in my stuff and the other required snail mail. They will contact the Congressional liaison with USCIS and inquire into your case.
Traviesa
Ok so just for fun I called USCIS and talked to their Customer Service. I asked her if there was anything wrong with our case or any particular reason that it hadn't been processed yet. She came back and told me (surprise, surprise) they're still working on cases from March 12. I said that since the date had been March 12 for several months, does that mean they are making no progress, and she said it depends on how many cases were received that day. She also said every case is done differently and that's why some may be approved faster than others. Her final words to me were that normally we're supposed to give them 180 days (I think that's where I got my 6 month idea) to process these cases. So friends, my thoughts to you is to wait the 6 months from your last touch and then do a Congressional inquiry. These phone calls are thoroughly pointless.

If you want to do it yourself, more power to you. I've already been through this entire process for a K-1 that we didn't get so I'm a little familiar with the way things work with these people. I would never waste my time making an inquiry on behalf of myself. Let the elected officials do what I'm paying them to do...

Heine i have answered you, see here in bold, the other day...i don't think you noticed...the reply stuff, i'm not good at it...with the quotes and all...sorry!

I saw your answer, but I didn't see any question to answer so I just let it go. Is there anything you want me to answer?

knowledge, when my husband had some problems with naturalization he wrote letters to 7 senators and to Governor Petaki or Pataki (i forgot). So, only governor answered him in 2.5 months, after oath ceremony was scheduled without his help. He wrote that he forwarded request to INS about my husband's case status. Before elections voters were necessary to them. But now..... I don't belive in their help.

Oh NYC_girl, sorry to hear what your husband got through!!!...it seems of what you explained that some decisions depended upon political interests and maybe political language...that doesn't help....But now, is another time!!!...Just curious, how does your husband feel about this 2nd immigration experience?...

knowledge! It's OK. We did it together. smile.gif How does he feel? Hmmm ... He trusts in correctness of all services and in correctness of their actions. But it is not pleasant to me. I don't believe the majority of them. They are mistaken and not competent sometimes. Sorry, but I have unpleasant experience of dialogue with such structures of authority. When the officer said to my husband "Wait till march" he is going to do it. But if I were him I would call to Customer Service every week. May be I have no patience?

Hi All,
I with all of you! I don't understand the concept of all of this. I'm new to this website VJ and I'm still trying to learn how to insert, add, etc. This is the least of my concern. I've been reading many of the posting and topics relating to my case (I also only filed for the I130 since I was told by USCIS that it was taking about the same amount of time to process as the I130) and I'm confused!! Many are approved within 2-3 months. It has been approximately 50 days since I received my first notice and I have not seen anything else since.
What do you all mean when you state its been "touch"? As I mentioned, I'm new to all of this and I'm trying to get myself educated.

Thanks and Good Luck to all!

Yes i understand, i'm not originally from Can. and the opression in some countries have been quite damaging in us believing. Things are difficult now but will be fixed, you'll be there. I began to read about the creation of the US, and the basic ground is freedom and intelligence...even if there are much difficulties...they'll be fixed...I have been advised to wait and not call or send anything, because they have tons of papers and it might get lost. The agents who answer the phone, I have read from serious source are not knowing anything about the proceedure...I know, it's physically frustrating... I still believe one route is the best, seeing all the confusions with the other redoundances...I keep fingers crossed for us to be approved soon!!!!!

Hi Radu or Mari, nice to meet you and welcome! 1st thing, careful with panicking lol...before anything...in case the process might be delayed...I don't understand all you said, so let's try by what i have understood: it's that you have applied for the Cr-1, I-130 and not for the K-3 (same I-130, then I-129f)...Some choosed to take 1 route (cr-1) or both (with the K-3). The latest news is that at the 2nd phase where the initial application goes for those who applied for both, USCIS (i think) retain the I-130 to let people continue with the K-3.
Cr-1 is an immigrant petition; K-3 is a spouse petition and non-immigrant, that allows to get in US, from where they AOS (adustment of status, i.e. immigrant status) which is the second part if you want of the Cr-1 (which alone is done only from outside the US). You can consult the sources, the Guides in here by the names of the petitions, then the Timelines where you can search for your type of application of how much time it took for others in similar situations.

The sources documents explain a lot why the waiting, etc...usually is because either they are loeaded with work, or because there are security checks that they wait for to be approved. The touches (you can in Search put "touch" and read all postings related to this topic) mean usually they have looked at our petition and so on...we don't know yet what is they are looking at...but this is all we know...
We, the girls in here wait now for a few months...we wanted to call or sent some infos (like in my case), we have told that we should wait around 6 months before anything...Some are getting approve fast or not...We don't know either why...or have some theories, the past divorces, etc...they have to check more...My theory is that people who are younger/ or not but have not yet much baggage of life might be approved faster...
Hope it helps a little bit...and/or if i'm not correct about your type of petition, please feel free to ask...
So, you are in the boat now...Congratulations!...be patient because it's easy to get nuts with the confusions lol...with time it will be more clear... yes.gif

Not sure if filing for I-129F/K3 visa helps as I filed for both, and the K3 petition ended up being forwarded to Vermont and I have yet to receive NOA2 for that too.

Thanks!

We calculate times based on other members filing and approval dates for the same benefit at the same service center that filed just previously to you (giving us a number that when averaged over many people and some other manipulation represents an estimate of when you can expect to be approved). If the USCIS official page shows that you are past due (your case appears to be per their definition) than the USCIS page has instructions that you should follow.

Good luck!

Thank you Capt. I realized later that my initial post was incorrect, ingnoring all the details you explained. Actually, i don't know anymore what's "past due" other than feeling past out, parked on here..or there who knows...lol...Ok seriously...gathering info here and there, i believe we are past due after 180 days...or 30 days after vermont timeline of current 12 of march..which woud be mid april approx. no info either on the NOA1 about the exact time when we should consider ourselves "passed out"...( lol sorry i just can not help it)...So on that receipt they only give 2 phone numbers...which we are going to use...or abuse lol depending...Also we are waiting news from the Congressman...So bassically...still don't know what passed due means in terms of time...
Thanks again for your concern, it's greatly appreciated!!!!
