hi,
just got the intent to deny cause of having a previous k1 visa approved.
they want a waiver from me.
just how complicated a letter do they want, and what further
evidence can i provide that i already had sent in with the petition.
i can give them copies of letters and phone bills in the last 4 months of
waiting.
any hints as to what to write would be helpful.

yes, my last k1 was approved in 2005.

I wrote a request for waiver to USCIS. I stated the problem of why I withdrew my previous petition and decribed how I met my current fiancee and included copies of my previous NOA1, NOA2, and my withdrew petition notification from USCIS. I also included our pictures and airlines tickets/boarding pass of the 3 trips that I have visited my current fiancee. Anyway, USCIS have approved my petition. Good luck!

What is it that you think letters and phone bills contribute to your petition?
How do you expect to receive advice on what to write for a waiver request when you provide no information about the situtation that requires the waiver?

There are some samples of waver letters for a K-1 in this section if you look through the posts. Mine has been sent off and i am watiing nervously for word on it.

The letter need not be complicated. Can be as simple as the sample below.

U.S. Citizenship and Immigration Services

Any Town, Any State
To Whom It May Concern:
In compliance with the International Marriage Broker Regulation Act (IMBRA), I respectfully request for waiver on filing limitations in connection with my current petition.
A waiver is appropriate in my circumstance because I have no criminal history with regard to the “specified crimes” under IMBRA. I have one prior approved Form I-129F for Ms. xxxxxxxxxxxxx of the Republic of the Philippines, WACxxxxxxxxxx, MNL2005xxxxxx. Our relationship did not work out in the end so I did not pursue the petition anymore. [You might want to add more info here as appropriate]
Hoping for your kind consideration of my request.

Everyone is required to respond to the IMBRA questions on the I-129F. Under certain circumstances dependent on your answers and situation then a waiver may be required. (multiple previous petition filings, certain criminal convictions, etc..)

If you have had two previous K-1 Visas for different fiancee's you are required to write the waver letter.
If you have filed a K-1 visa application less the 24 months prior to the current one you are required to do the same.
I have not paid quite as much attention to the other qualificatins but basically if you have been convicted of domestic abuse, have three convictions for substance abuse, have a felony conviction (It may have to be a violent crime) or something close to that you are required to file the waver letter.

I got my approval today with waver request too. I was happy to see that. It seemed like it was taking forever for Vermont and the waver deal really had me worried that they would turn it down. Now I can breathe a little and get ready for the next chapter.
