Hello there,

I need to know if it is okay to send I 751 one month before the Conditional Resident card expires?? Does anyone have similar experiences with that??

you can send it in anywhere in between 90 days and the day your green card expires....

Yep, there's a window that opens 90 days before the expiration, and closes on the expiration date. Most people strongly recommend filing early in the window, but as long as you get it in during the window you're OK. The sooner you get it done, the more time you have to correct problems if it's not accepted for whatever reason, and the more "cushion" you have in case of unforseen problems or delays.

Is there any risk if I send 1 month before the card expires? My card expires on May 16th 2007 and if we send the application on April 5th 2007, is it safe for me? Because we already planned for vacation from march 16th to march 31st.

In order to re-enter the U.S. after travel abroad, you need an unexpired GC. If your GC has expired, you need to have a I-797 Notice of Action, which you receive after you have submitted your I-765 application, and this Notice of Action extends your conditional resident status for a period of one year.

So, as long as your travel is completed before the expiration date of the the conditional GC, you will be fine submitting your application one month before expiry date.

Yes i will be coming back to US before my expiration date. My card expires on May 16th 2007 and I may be coming back on March 30th 2007.

And will submit the aplication in first week of April 2007.. Do u think it is fine??

yes, it will be fine... you can mail it anytime within the 90 days before your green card expires...
