well i talked to the embassy in frankfurt today and the lady said there would be problems if i apply for my 10 year GC from here.. so i am gonna fly back to VA after the baby is born.. april or may.. now to my question.. do u think they give me any problems when i fly back to the states and my 2 year GC expires about 4 weeks later..?

my 2 year GC expires june 8th 2007..

thanks

I think you need to file the I-751 90 days before your GC expires. They will give you a year extension to allow time to process the petition to remove restrictions. I think if you wait and let the GC expire you could be considered as abandoning the LPR status.

Read the guide here on VJ, it specifically refers to filing 90 days before the card expires:

Not exactly... You have a 90 day window within which to file. It expires with the expiration of the two year green card. You can file at any time during that window.

As long as you enter the US before your card expires, you'll be fine. With only four weeks left on the green card, I would have the I-751 paperwork compiled and ready to send as soon as you return. If something goes wrong and the filing is rejected, then you might have problems since the peition is not considered filed until it has been accepted by USCIS.

I filed from Germany, and had no problems...
Refer following link, re my story in the I-751 forum My i-751 story.

I came back to California at Christmas to have my passport stamped, and produce 3 passport pics in person,...Apparently my New 10yr g/c is in the mail, as I type.
