My brother in law received his EAD card today and it says valid from 12/22/06-1/28/07.. for 30 days only !?!?!?. He came and got married on October but he hasn't applied for AOS yet. I thought EAD is valid for 1 year after applying.Is this some kind of a mistake when they processed his application?

Your brother-in-law apparently applied on the basis of being a K1, his card is good for his duration of stay as indicated on his I-94. He did pretty good to get 30 days!

EA on the basis of being an applicant for adjustment of status is good for 1 year. You write that your brother-in-law has not yet applied for adjustment of status.

Is EAD renewable? He's going to mail his AOS next week... Or he should have filed for AOS first before EAD...

Yodrak is right on the money. My only odd-ball question becomes... Will Kayz's brother in law have to pay AGAIN for a EAD that will be good for 1 year once he applies for the AOS? My intuition says yes, but I'm not really sure.

The EAD are not renewable after they expire. Just apply for another EAD 90 days before the active one expires. Hopefully before the 1 year, you will have your green card.

Yeah he'll have to pay again. He can apply for the EAD at the same time as he applies to adjusts status (I would imagine). I don't think that an EAD based on a K-1 Visa would be renewable.

My sister recently switched jobs. Her last day from the previous one was Dec. 8, 2006. She will start working for the new job on 1/2/07. Is it OK to file for AOS now since they need to submit an Affidavit of Support as well?

hi, it seems that it depends will give AED that how long the expiration because, mine I got EAD valid from 03/06/2007 till 06/05/2007...for 90 days. hmm blush.gif
