Full Version: Can a beneficiary be added to a pending petition?

Hello all,

My question is about adding a beneficiary to a pending petition. My uncle applied for his sister about 13 years ago. Their case now is at NVC stage. For some reason, the petition only lists his sister's name along with the youngest child, who is now about 15 years old. Sister's husband & two older children (25 year & 19 year old) were not listed as beneficiaries. My questions are:

1- Is there a way to add these "missing" children to the beneficiary's family. At least the younger one might have a chance of coming to US.

2- How long does it take from this stage till they get called for the interview @ the embassy?

One benficiary per petition.

An I-130 petition? (Has to be.) No derivative benefits for children. Each immigrant needs their own petition.

So what does the woman do with her children? Is there any option? Will she have to file petition for the children after she arrives in US?

Also, how long till interview from this stage? any idea?

Damn, I gave you bad information in my 1st post, should have checked before writing it. The petition does cover the spouse and unmarried children under the age of 21 also. I appologize.

I think you should have a consultation with an immigration attorney to discuss the situation and get answers to your questions. It may be possible to identify the missing people to the NVC and get them covered, on the other hand doing so may cause the NVC to return the petition to the USCIS for re-consideration in light of the previously withheld information.
