Hi Folks,

I have a few questions regarding how my daughter's case will be processed by NVC. Here is a brief background:

Currently my wife's case is being processed by NVC. I have submitted Affidavit of Support (AOS) and the related supporting documents to NVC. I have received IV fees bill from NVC but have not paid it. The reason I did not pay IV fees bill is that I was waiting for my daughter's I-130 to be approved by USCIS. My wife's petition did not include my daughter. Now since my daughter's I-130 has been approved and will be transferred to NVC, I need to find out how her case will be processed by NVC. My specific questions are as follows:

1) Will I need to submit Choice of Agent Form for my daughter who is 4 months old?
2) Will I need to pay Affidavit of Support Fee Bill again for my daughter? I have already paid it for my wife and I remember the instructions mentioned "If you are a US Citizen, filing a separate AOS for your spouse and children to immigrate, you only need to submit one $70 fee, which will cover your spouse and children".--- My concern is that I do not want to waste time waiting and submitting these documents again.
3) Will I have to submit NVC all supporting documents that I have already submitted with my wife's AOS again?
4) Will my daughter's case category be IR1 or CR1?

I would really recommend calling the NVC regarding most of your questions.

As far as your daughter goes, my understanding is that regardless of what status she enters on (probably IR1) because you are a citizen, she will be immediately eligible to file a N-600 for citizenship. I'm still a little uncleear as to that process, but check out the citizenship forum later.

I would contact an immigration lawyer to be on the safe side. I know at one point this statement was true but not sure anymore. The laws change so often.
