Hi,

I am a US Citizen currently working in New Delhi, India. I got married to a student visa holder and filed for I-130, I-131, and I-485 in September 06. We filed for I-131 because we knew I had to come to India for an extended business trip. USCIS sent a RIFE for I-485 a couple of weeks ago which means that they still haven't started processing our I-485 and I-131. It has already been 2 months since I came to India and we cannot wait any longer. Here is what I want to do and wanted to see if anyone has any suggestions/experiences to share with:

1). Withdraw I-485 and I-131
2). Let I-130 to be processed in US and have my wife join me in India.
3). When I-130 is approved, ask for it to be transferred to New Delhi Embassy by filing I-824.

Now I am not sure how long it will take for the case to be transferred and interview/medical to be scheduled in New Delhi after it is approved is US. We already had submitted I-864 and we have an agent (lawyer) appointed so the two steps in NVC where you send a completed I-864 and DS-3032 will not be required.

My questions:

1). Since they requested RIFE for I-485, can I assume that my I-130 application is already being processed and I can expect it to be approved in about 6-7 months?
2). How long does it take approx. to have the file transferred to a foreign consulate and an interview/medical to be scheduled?
3). Will this complicate our case? Should we wait for AP to be processed (which can take another 90 days) and then have my wife join me?
